^They've got to keep the testimony away from the jury at all costs, otherwise they won't be able to put away their man.

If it wasn't Brad and they somehow caught the real killer they'd probably still proceed with the trial.

I'm not commenting on whether or not Brad is actually innocent, but the prosecution damn sure hasn't given me anything to even think he did it.

I get why the prosecution doesn't want it, but I don't see why it wasn't an option for the judge or defense especially considering that one of his reasons was that the prosecution wasn't given enough time to prepare. What if the defense waited until next week to call him? Can they find another expert, give notice today and give the prosecution a week to review the data?

This guy testifying now is pretty funny to me. I like how he was asked about his work experience and he launches into giving a history of telecom companies and wireless technology going back to 1946.

lol he also just said he has been in a lot of cases with "policemen acting as amateur forensic people"

Wow--instead of admitting that CPD erased the phone, those websleuths people are trying to say Brad "bought an identical phone and switched it with Nancy's" or "Brad must have removed and replaced the SIM card himself to confuse everyone" and "Brad had a special program that would make it automatically wipe."

That wasn't enough notice to adequately research the results or consult with FBI computer experts who were away on assignments, Zellinger said.

Zellinger added he also had concerns about the findings, because it was based on tests and data from the previous defense expert, Jay Ward.

"The prejudicial effect far outweighs the probative value of this evidence, at this time," Gessner said.

Prosecutors say Brad Cooper, 37, strangled his wife in their Cary home in the early-morning hours of July 12, 2008, and dumped her body at a construction site in a neighborhood 3 miles from their home.

The state's case relies mostly on evidence found on Brad Cooper's computer of a Google Maps search of the site where Nancy Cooper's body was found. It was made one day before she went missing.

Brad Cooper has said his wife went jogging around 7 a.m. that day and never returned home.

His attorneys have questioned Cary police investigators' work in the case, accusing them of ignoring witnesses and evidence, tampering with the defendant's computer and purposely deleting data from Nancy Cooper's BlackBerry Pearl smartphone.

Ben Levitan, an expert in wireless telephone systems, testified Monday that the phone wasn't properly protected while in police custody and that the account of how Cary police investigator Jim Young wiped the phone was in inconsistent with the actual process of deleting the data.

Young testified that he accidentally wiped the phone in August 2008 while trying to unlock the phone based on the cellphone provider's instructions.

Levitan said he would have expected a report explaining what had happened but that there was none."
