Yea, except you didn't predict the part where the Bush administration comes up with a transparently phony story to cover for her withdrawal, then slinks away as quickly as possible to avoid any bad publicity.

I mean -- attorney/client privilege? Like they wouldn't know, prior to nominating the top lawyer, that she'd be asked to give up those documents? Yea.

This whole affair is a really sad display of limp-wristedness on the part of the whole administration. They quite obviously weren't able to manage the nomination process; and worse, they were willing to let Arlen Specter run the whole show. That doesn't bode well for any nominee. Ceding so much power to the judiciary committee and the pre-confirmation-vote process basically is asking, begging for another Bork-style battle if anyone slightly controversial is nominated.

Just on the basis of the separation of powers, Bush should've demanded the nominee go to a vote. Caving to political pressure at this point is preposterous, weak-willed, and stupid.

Specter was in favor of her nomination and against the withdrawal. He was actually trying to help her case when he made the comment about her just needing a crash course in constitutional law.
