Here is the thread about the accident my vehicle was involved in. The insurance of the vehicle that slammed into mine took care of repairing the car, and I've had it back for a few months now. I've had a lawyer trying to handle the case for me, but apparently he sucks ass. I called him up yesterday bitching about why he hasn't gotten me a diminished value check from the insurance company, and he tried to tell me that they don't do that for older cars. This car wasn't even 2 years old when it got wrecked, as it was a 2004 model. Everyone else I talked to said that getting a diminished value check in the state of NC was a very simple matter, as the courts here have upheld cases about it.

The lawyer told me that I might be able to get an appraisal done on the car for after wreck value in order to get some money out of them. Is this really necessary? Shouldn't I be able to just use the difference between KBB for a vehicle in mint condition and the vehicle after the amount of damage it had done to it? The cost to repair the damage was about 65% of the cost of the vehicle.

If I need to get an appraisal done, where would I go to get one done that would be accurate?

my roommate got a check for this a few months ago when someone hit is '00 SS Camaro
so you should be able to get a check

what did he have to do to get it? I know it shouldn't be a hassle, but my lawyer is a fucking jackass and I need to know what to tell him.

the KBB retail on this car is $23,500, yet there's no way in hell I could get more than $12k for it with the damage that's been done. I'd be happy just getting a third of that.

Does it have a salvage title now? If so, I'd be going apeshit. If not, I'd be selling it on ebay.

I'm not looking to sell the car really, as I plan on driving it into the ground to justify why I bought it in the first place. However, I was hoping to buy a house in the next 2-3 months and it would be nice to have the money to contribute towards a down payment.

If the damage to the vehicle is over half of the cost, then you should have no problem getting a diminished value check.

yeah...your lawyer sucks, most normal ppl can get checks out of insurance companies with a hit in the vehicles value that large, good luck

I've gotten diminished value. My Saab was worth $10k when it got hit and I got $850 for diminished value.

I didn't have a lawyer. I just called the other guys insurance company after I settled all the other shit and said I wanted money for loss of value. They sent out an independant appraiser at their expense. I ended up shooting the shit with the guy for about 30 minutes. I made sure to point out the little flaws like slight orange peeling in the paint and my rear swaybar being scratched. A few days later the appraiser said my car went down by $850 and they offered a break-even check for that amount...Nothing more, nothing less.

I called the insurance company myself today and they refused to send an appraiser to look at it. does anyone know of an appraiser in the area I can get to make a report on the value of the car?
