my parents have been divorced for 5-6 years or so, and my mom is a real estate agent, so i don't see how she could be considered "financially dependent". my dad didn't cheat on her or anything, either, and he still pays a LOT of alimony.

It's not tough to show that you are "financially dependent". I think its usually hinges on whether or not you can keep your same type of lifestyle without the significant other's help. If you can't, then you are financially dependent on that person to maintain that lifestyle. So normally, whoever makes the most ends up having to pay some type of alimony.

However, "financially dependent" are the words used in the law.

we al know the law doesnt work that way it is geared towards helping the women, they are the weaker species, always have been

they want all this equal rights crap but then all these friggon laws are one sided helping them whether they deserve it or not

not this this may be a case of it, but just in general

Goodness, some of you people are dumb. It is about who is "financially dependent" before the divorce.

And how does it work out that if someone gets half of the stores, they become the person who is better off financially??? If anything, it gets them closer to being equal, but in no way does it make them better off.

^From the tone of the post, it can be taken that most of the blame is on the father's side. Whether or not that is correct, if everyone is going by the initial post, then it looks like the father is the one fucking up.

But you're the "manly-man" and you always have to defend the male in situations like this. Bottom line is that if you're looking at this from an unbiased point of view, it's probably the husbands fault...add to the fact that a majority of the time it usually is the husband fucking around on the wife...that makes your post look more like a troll. Either way, you're doing your duty as a big bad male to take up for this man....so gg.

Here is what you need to do:

Go ahead and hire the PI but keep the evidence yourself.

Present the evidence to your father.

Inform him that the evidence will disappear if he pays you off.

Profit

This way they will both hate you, you wont be taking sides and youll get lots of money.

What language does she speak-

You can always find a lawyer that speaks the same language. I believe you can search on Martindale.com.

ok, if he just decided that he wants a divorce, you've got some time. NC law states that a married couple must be seperated for ONE YEAR before a divorce will be granted. that means no sex, no living together, etc. So, even if he says that it's been a year (and it hasn't) your mother can show that it has not. She has some time. Further, instruct her to sign NOTHING without having someone read it that will understand it (seperation agreements and divorce documents are all legalese) and can explain it to her. She does NOT have equal right to assets if he gets her to sign a seperation agreement stating that she does not. It is extremely difficult to fight a seperation agreement. So, she needs to put a lawyer on retainer, document their living arrangment to show actual seperation date, and understand not to do a damn thing without talking to her lawyer first. If she wants to hire a PI then she needs to talk to the lawyer about that as most will have someone that they normally work with that they can recommend. That way it's someone that has previously proven themselves and she may even get a better deal since it's the lawyer's preferred p.i.

And yes, I'm going through a divorce right now. I signed a seperation agreement when I was on medication and not of sound mind. I ended up giving my damn house away and losing $40k profit on it as well as a LOT of other money. My situation is the easiest to fight since it can be proven but I finally said fuck it and started my life over. The money it would cost and the headache it would be to go though it just isn't worth it.

Actually, if she does not speak English and signs any document, she has a very strong defense to get it thrown out.

Unless someone is around that speaks her native language and English or she has time to consult someone.

So lawyer peeps, she will get half if there is no prenup, whether or not the dad cheated, so hence PI not needed?

I agree, shitty of your mom to ask you to hire a PI on your dad. Since I don't know the circumstances behind your dad's infidelity or their marriage, I'm going to reserve judgment.

You aren't obligated to do shit for your family. Seriously. I tried being the "good daughter" and I'm out 2 cars, my savings, and a CC that was taken out under my name.

Sometimes parents need to just adult up too. The best you can do is be supportive, but still don't get in the middle of shit. It ain't your life.
