Yeah there are several scratches on the toshiba but operates fine and doesn't look too bad.

The Blackberry should and will work with cingular.

Just FYI to anyone buying a new phone-- because of a new law passed in the past year, if the phone is not equipped with the 911 GPS software it can no longer be activated... so just make sure you know what you're buying! I found this out after I purchased a used phone off TWW and took it to the store to activate.
