i'm fuzzy on all the details - i've forgotten, and didn't really follow it at the time.
but probably 3-4 years ago or so, jackleg was snooping around on an unprotected NCSU server and ran across the password for the NCSU Public Saftey online police blotter, in plain text and unprotected.
so of course jackleg posted the password on TWW and everyone went crazy on the blotter, posting fake police calls (kind of like the think with News Channel 14 snow line).

somehow [user]snerf[/user] and someone were involved in it from the beginning, and the 3 of them were arrested and charged with something. It was sensationalized and they were called "hackers" and all that.....

this case in CA is something similar - if you leave private content unprotected on an open server, and someone accesses that data, is that "hacking"? I don't think so. Is it right or ethical? No, not really. But is it illegal? That's what this case will tell us.

I look at it like breaking and entering. If someone leaves their door wide open you still aren't really allowed to run in and take a look around and possibly take something if you really want it. They may not have circumvented any protection but they shouldn't have been connected in the first place.

Based on what? Walking into a home with an unlocked door is not analogous to posting information on a website that is publicly accessible. There was no warning or other information indicating that knowing the password was not sufficient enough to be allowed access to posting on the blotter. Assuming that fact should not have been sufficient to charge them.
