Irony #1: I work in a law office.

I got a possession of a malt beverage under 21 years of age ticket 6 months ago and was granted the "First Offenders" program...

And then I became a second offender for the same offense However, the cop told me that I had to just pay the ticket off (the second one) and all would be hunky dory.

So I go to court the get the first one dismissed for doing the program, find out I have a warrant for my arrest bc I was-unlike the popo said-to attend my court date, and get two new court dates to get the whole mess settled out.

Irony #2: One of the court dates is on my 21st birthday.

The dilemma - if I get convicted of one, I am automatically convicted of the other.

Any advice of how to get lucky and get them both dismissed? (I'm a bit stubborn and refuse to get a lawyer - or in any case try to get one of the lawyers at my job to cover my ass).

I'd get one of your lawyers to take the case for you (maybe even at a discounted fee) or if you don't want them involved get Crouch, because that man has pulled off some crazy shit.

For the first offenders program I was only to not get another offense in the 6 months until my dismissal date, which I moronically failed at.

But yes, lawschool is my main concern with this whole ordeal.

Perhaps I need to stop underestimating the situation and get a lawyer.

You are also fucking stupid as shit for taking legal advice from a fucking cop. Not just a cop, but the one that gave you a fucking ticket!!!! I am pretty suprised you want to work in the legal profession but are stupid enough to beleive what cops tell you.......Thats a class 1 misdemeanor on your record if it goes through. In the future you will likely have to report that on applications for professional licenses, employment, or places to live, you can be denied any of those things for that conviction or failure to report it.

It is a bullshit charge, that you can get dismissed, but you need to take it seriously because if you have it on your record and ever get in trouble again it will be considered at sentencing. It is worth the extra effort to keep your record clean.

If I get convicted of the second ticket, then yes, the first offenders program will be thrown out.

My insurance law professor pointed out that a police officer should never tell anyone to just pay a ticket. Technically, its practicing law without a license.

Get a lawyer from your job to help you out. While you will have to put both the tickets on your law school and bar applications, it looks better to have it taken care of.

Haha, for once I'm glad to be beat. I mean, I know I'm not a bad kid, I guess I just make stupid decisions, apparently But I'll be sure to give Mr. Dodd a ring-a-ding.

My failure to appear has been wiped off, thankfully, because the cop had told me that I just had to pay and not go to the court date. Bad thing is, I already sent in my ticket cost and court fees for the second ticket, because the cop told me to. And by me sending it in, I apparently pled guilty (unfortunately didn't pay enough attention earlier and didn't find this out until I got to court). So now I'm confused as to whether the judge erased that plea by giving me another court date for the offense or whether I'm going to go to court and they're going to be like "What are you doing here? You already pled guilty"...

Guess I still have a lot a learnin to do left in law school.

Any thoughts?

Maybe your lawyer can ask the judge to overturn where you plead guilty by mailing in the ticket because you were acting on the legal advice of someone not licensed to dispense it. (a cop)

It does however say right on the ticket that if you sign and mail it in you are pleading guilty so I dunno how thats gonna go over.

Im sure once you call the lawyer they will tell you what they can do with it.

did you think that when sending in the fine+court costs you were pleading not-guilty in your absence?

this is not something you should pick up in law school - this is something just about everyone should know but especially people that have gotten a ticket

1.) Don't ever mail in a ticket. I don't care what anyone else says, always bring it in with the payment yourself. I have seen more than one person get a "failure to appear" subpoena because their payment got lost somewhere in the mail and/or courtroom payment office.

2.) Get a lawyer. You pled guilty by mailing the 2nd ticket in, and the only way you are going to fix this is by hiring a lawyer...preferably one that is friends with the cop and/or the judge that are involved in your case.

In all honesty, I thought it was just a fine, due to the fact that he just said that I had to pay it off and that everything would be fine. I did look at the ticket whenever I got it, but was upset and must have looked over the "now important facts". I sent in the money the next day, thinking that I was scott free.

Sorry I'm not up to par on drinking tickets/citations/fines. The whole situation was much different from the first one I obtained, so I wasn't sure what the hell was going on. And I've never been in any trouble with the law before - so yeah, I was naieve and stupid. Maybe still am, but atleast I have to grace me with your almighty knowledge of the legal system.
