I think if he had used a gun in his crime he could have been considered likely to use a gun. But since he used a blunt object, theres no reason to believe he was "armed and dangerous". People like to throw around these cliche terms, even law enforcement.

If the sheriffs were told he might be "armed with a 6 inch blunt object", trigger happy rednecks who just got thru training at the appropriately named "kill house" might have thought twice before they gunned down everything on the whole damn block without even seeing the suspect (shot through the door). New Hanover County Sheriff's heads should roll after this...this was a grossly excessive, ill conceived, poorly executed raid that is undermines the very notion of our society. If we have roving murder squads who won't even see a suspect before resorting to gun play, then that is disturbing. Think if there were kids in that house. It makes me sick.

They got "lucky" in shooting him. It could have easily been anyone else in that house. Not only that, but Ryan Mills (The person in ALL the gun photos, Peyton isn't in any) was NOT at the same location when this happened from my understanding.
