Here I thought I was being responsible by riding a bicycle instead of driving a car after I was drinking. soon I won't even be able to walk down the street without being charged with a DWI. 10/28/2007 11:14:20 PM

Agreed. We used to ride bikes to parties all the time back in the day because we didn't want to get a DUI. This is ridiculous MADD legislation at it's worst. ![](images/mad.gif) 10/28/2007 11:40:17 PM

NC General Statute
20-138. Operation of Vehicles and Rules of the Road Impaired Driving-----20-138.1
(e) A bicycle is not considered a vehicle for purposes of impaired driving.
... reckless driving though, definitely.

thank god the cops in sweden dont care or else they would make a killing giving duis to people on bikes. we ride our bikes everywhere, especially to and from the bars. its almost a sport to see who can make it home drunk without crashing. 10/29/2007 12:03:03 AM

The cops will give you a DUI on just about any conveyance:

And sometimes when you're not even driving:

As far as the law is concerned, if you have the ability to control the vehicle, it doesn't matter if you never move the car. Best thing to do is sleep in the back seat with the keys in the glove box. That way you're out of control.
NC DWI laws also cover ATV's, and golfcarts. 10/29/2007 12:54:27 AM

Yet the clowns driving the Zambonis (or Olympias) drunk couldn't be charged because zams aren't considered vehicles since they don't carry passengers (except for every single one I have seen at NHL games). The story didn't come from our state so maybe had I driven over to Gypsy's tanked back when I worked at The Ice House I could have been charged. Go figure. ![](images/beatup.gif) 10/29/2007 3:07:44 AM

this wouldnt have been an issue more than likely if:
A) the bicyclist didnt crash into a car
2) the bicyclist was only 16 and drunk 10/29/2007 3:34:02 AM

Yeah... I definitely just used the comment feature to send a note to the web editor.
They need to take their addresses down. Why post it for the under-age minor kid who was charged and why post the same for the guy who just happened to be in the wrong place at the right time? No good reason to post that shit.
Hopefully they just edit out that part... 10/29/2007 3:51:15 AM

i think that may be old... they re-wrote the law last december because mopeds are not considered motor vehicles yet they were concerned about drinking and driving on them. the way the current law is written you can get a dui for skateboarding drunk too. 10/29/2007 5:59:31 AM

here in Delaware I've learned it's a ticketable offense to walk drunk. I've even been pulled over before walking home from a bar. In that instance pretty sure he thought I had seen him and i was doubling around waiting for him to pull off before getting behind the wheel.
and in my defensive driving class they literally tell you that if you're going to sleep one off in your car, to hide the keys somewhere outside the car. if you have the keys on you, it's a dwi, if they're not in the car, it's not...
absurdity.
