You do not have to have made a foreign purchase:
Quote : | "Any person who held a Visa-, MasterCard- or Diners Club-branded credit, charge or debit/ATM card issued in the United States as of November 8, 2006 is a member of the Settlement Injunctive Class. Those persons who made a foreign transaction on at least one of those cards between February 1, 1996 and November 8, 2006 are members of the Settlement Damages Class. Only members of the Settlement Damages Class may seek refunds by submitting a claim. If you are only a member of the Settlement Injunctive Class because you did not make a foreign transaction between February 1, 1996 and November 8, 2006, you will still benefit from the settlement, which requires certain disclosures to cardholders concerning the rate used to calculate the U.S. dollar amount owed for a foreign transaction and any fees applied in connection with a foreign transaction." | ]12/10/2007 2:14:29 PM |

You may never get a refund ID. Think about the number of people who have a Visas and MasterCards. Then think about how many people (er, teenagers) get a Visa or Mastercard for the first time each year. It is impossible to get notices to every single one of those people.

I'm so scared of identity theft. I'm affected under option one. I'm assuming I can use an old card/account number which is what was used at the time. No one can trace that to a current number can they? This is also asking for the last 4 of the social. 12/10/2007 3:28:48 PM |

so what's the deal with this stuff? 12/17/2007 12:09:58 AM |
ambrosia1231 eeeeeeeeeevil 76471 Posts user info edit post |
^^Supposedly, no. BOA is less than careful about it (e.g., identity theft victims closing accounts...and BOA linking the new, "safe" accounts to them, and then the new ones get drained).
You should be fine.
Will this open you to identify theft? It better not. It's less risky than, say, shopping at TJ Maxx.
^What exactly is your question?

1. is there any real downside to cashing in on this $25?
2. in summary, what are the grounds for these reparations? 12/17/2007 12:22:29 AM |

So I added up all my foreign transactions from the time period covered and calculated what I was owed ... and it was pretty much the same as the $25 boilerplate settlement. Bleh.

I got the notice in the mail. I am thinking of going with the fill in your amount option. I am thinking I should get 300 back (or 1 percent)... not sure if I should try that route though. 12/17/2007 2:10:09 PM |

if you spent more than a week out of the US and over $2500 then you can do the other options
if it was less than one week and less than $2500. you are only getting $25 12/17/2007 2:58:38 PM |

Quote : | "When will I get my refund? Refunds will be paid after the Court finally approves the settlement, and approves any award of attorneys' fees, awards to the class representatives, and allocation of the settlement fund among Settlement Damages Class members, and any appeals related to that approval are resolved. It is possible that this could take several months, or, if appeals are filed, several years. You may want to check this website from time to time for updates." |

Forgive me if im reading this wrong but:
Quote : | "Who may submit a claim?(top)You may submit a claim if you made a foreign transaction between February 1, 1996 and November 8, 2006 with a U.S.-issued Visa-, MasterCard-, or Diners Club-branded card. Only the primary card holder (the person who is primarily responsible for payment) on an account may submit a claim. If you choose to submit a claim, you may do so only once." |

I read the above quote as saying only people who have foreign transactions can claim money. The injunctive class will benefit because disclosures concerning rates and fees will now be required.
I could be completely wrong but I didnt read anything else that was even ambiguous about everyone getting $25. I didnt fill out the form though so maybe theres something more concrete there.12/21/2007 1:46:01 PM |
