so this morning i got pulled over for merging out of a right-hand turn only lane (how lame is that), and when the cop pulled my license, it showed a warrant for an unpaid speeding ticket i got in SC 3 years ago. so i ended up in handcuffs while the cop checked with SC to see if they wanted to extradite me. Fortunately they didn't so he let me go and apologized for the inconvenience. I know I paid the ticket b/c I remember having to drive 2 hours to see the judge and pay the thing, so SC screwed up somewhere. I just gotta figure out who to talk to to get it fixed.
should i bother getting a lawyer involved, and what are my chances at suing somebody for the "emotional distress" caused by SC's screwup? 12/17/2007 12:50:41 PM |

Happened to me for a ticket in NC once... I had mailed the money for court costs or whatever in and apparently they didn't enter it into the computer right. Like, if they read the details on their computer said they had received the money and my license was valid again, but the license status was still set to revoked so the cop didn't care about anything else. Fucker towed my car and cut up my license... I ended up getting a new license for free but they wouldn't pay me back the towing fee for their mistake.

when americans screw up, they pay for it. seems like it should be the same for the govt. if a lawyer tells me i can help hold law enforcement accountable, i'm there. if not, i have plenty of more important things going on in my life.

I am not even talking about exorbitant fines either. Just dime and nickel them like we are done.
Whoever failed to take the warrant out when the ticket was paid should get fined $25 dollars Or the agency responsible should be fined that much. qntmfred should get all of the $25.00. If that DMV or clerk of courts office had to pay those fines they would figure out ways to operate more efficiently without fucking up or fire the idiots that are making the mistakes.
That way employees that fuck up a lot would get fired just like they do in any other employment setting. I know if I fuck something up at work that causes someone else a serious inconvenience I at minimum will get an ass chewing. If it happens too much they would find someone else to do my job.
If government agencies operated more like that we would all be better off.
I can send a box pretty much anywhere on the globe and know exactly where it is in about 10 seconds. Someone explain why its that hard for the courts and law enforcement agencies to keep track of who has a fucking arrest warrant out. ] 12/17/2007 1:21:49 PM |

^^um, the military does work like that. we have some of the highest standards of any workplace. but yes, i'd be the first to say that all the government should be held to higher standards

If I enter something incorrectly in the MLS my company gets a $300 fine the as soon as the inaccuracy is found. Guess who that fine gets passed to if they get hit with one.
I once got backcharged by a client $800 for a paperwork error that was a completely honest mistake. It cost him $800, he charged it to my company, they charged it to me. Mind you no one got arrested or detained for that but I was out $800 for one little fuck up.
This is not about self entitlement. It's about our law enforcement being able to know who they need to be arresting and who they don't. I don't see why it is wrong for employees of government agencies to be held responsible for mistakes. If the court employees and DMV can't keep shit in the computers accurate then how the hell are the cops supposed to do their jobs?
I got pulled under similar circumstances once and the trooper kept my license. I never did figure out why but a speeding ticket I had already gotten taken care of had my license suspended. The cop was nice enough to let me go (drive away) because he saw the charges were resolved but I had to pay $110 for a new license to the DMV. The ticket he gave me for driving with no license has yet to be resolved. I finally got a lawyer because I was tired of going to court only to sit there all day and them continue it because I would not pay the fine for driving with no license after already paying $110 to the DMV to get a new one. I would rather pay the lawyer $250 to fight it tooth and nail than $125 and have a conviction for something I did not do.

you mean for courts to have paperwork correct
law enforcement is a separate entity from the police
the cop can only act on the info he has, so if anyone is "at fault" it would be the district court in the county he was pulled in, but even then...there's no preexisting penalties for clerical errors at the DA's office, so any "victory" you claim will by pyrrhic12/17/2007 1:48:45 PM |
