So my boss just recently switched me from 10$ an hour to 400$ a week. She is basically doing it because my gf and I are working the same schedule and this way she only has to pay one of us the 2-3 hours a week of overtime that we will probably get every week. I'm only working there till the end of the summer and there are three days that I have off which I'll get paid so in the end I'll be paid more on salary rather then hourly.
But my question is - is anyone familiar with the NC exempt employee rules that make someone elligible for salary? As far as I can find I don't qualify to be paid on salary, also it seems the minimum to be paid for salary is 455$ a week. Anyone know more about it?
Edit: We are working as summer camp counselors at a place that I worked at year around camps too with the same amount of kids, so I wouldnt qualify under the basis that I'm working under somewhere seasonal.

This looks like a less than clever way to cheat you out of overtime. 6/16/2008 6:16:46 PM |

from the information provided, it appears that you should be non-exempt. 6/16/2008 6:20:14 PM |

Yeah like I said - she is basically doing it so she only has to pay one of us overtime. We both agreed to work this summer on the basis that we would have the same schedule so we could ride together (we live 45 minutes from work). I guess she is thinking that she won't get in trouble because only one person will be going overtime rather then both of us. Though with my 5 day weekend that she is giving me for July 4th I think I'll end up making a little bit more on salary, unless we both end up having to stay late more often then I'm thinking we will, though I doubt that should happen.
Basically if I were working anywhere else I wouldn't say much about it. But this boss is an idiot, crazy, and probably thinks she is being slick by putting me on salary. I've worked way too hard for her over the last year and want to figure out if I have legal basis to call her out for not paying me enough. Not to mention two of my good friends who worked all last summer at 400$ a week who wouldnt mind getting the money they are owed (if that is the case).
^ I'm trying to google all this stuff to figure it out but the computer i'm using is slow as molasses. What exactly would it mean if I'm non exempt?

i was paid 400/wk for a couple of months until I was switched to hourly.
Coincidentally I was working 40+ early on and never hit over 40 after. 6/16/2008 11:02:07 PM |

I would assume she is going to try to get more than 40 hours out of you without paying time and a half at some point/every week/or especially right before you're getting ready to take time off. Also she can make both of you work extra for free b/c she knows you ride in together.
