He does, my friend's lady works there and we talked about him last night. Apparently he's in his 30s and this is his 3rd dui. I'm not sure if I can / should say more

Yeah 4th DWI charge, but two others were dismissed. He has only been convicted once.

NC needs some tiered DWI laws.

Regular DWI - Temporary License suspension, ignition interlock required for 24 months for any type of early license reinstatement, plates confiscated to all your vehicles if you are not licensed so cops can catch you driving with no license. Offenders vehicle should be towed in at time of arrest and only released if tags are turned in or interlock device is installed. (this would also keep the offender from going to get the car from beside the road while still drunk which happens)

Aggervated DWI (for higher BAC, causing an accident, driving with kids in car, driving recklessly, or multiple offenses) - Longer License suspension, ignition interlock required for 7 years on any vehicles you own or drive. If multiple offenses vehicle seized and sold. Require vehicles registered to spouses or others the offender lives with to install interlocks or fill out affidavits that under no circumstances the offender will be allowed to operate their vehicle (with criminal penalties attached for breaking the agreement).

The state does not have the money to lock up or keep all DWI offenders on probation, there are other solutions that would accomplish the same thing, ignition interlocks, or taking license plates or even the whole vehicle. Taking a little card away from someone that says they can drive does not help the police spot them driving with no license....

If there was multiple DWI tiers, prosecutors could plead them down when they have a case with potential problems, and still get some penalties against the drunk driver. (this happens all the time in criminal cases)

It would potentially speed up the courts, it seems like pretty much every DWI case that has an attorney goes to trial because there is nothing to gain by pleading guilty to a lesser charge, there is no lesser charge and so you might as well fight it all the way. The courts have limited resources and should be spending more resources on the worst offenders than they do on someone who happened upon a roadblock and blew a .08.

The driver of that car was a former coworker and friend. I was supposed to meet up with him for coffee last week but we had to reschedule. He has a little girl and his wife is due with twins next month. Really sad situation. No clue what he was thinking, but this does not seem like something he would do.

The state actually does have a 5 tiered sentencing system for those convicted of DWI. They even recently added a sixth (Aggravated Level 1). However, it isn't as extensive as your proposal and offenders are often pled down to lower levels than they history would suggest.

In theory, offenders placed on probation are required to pay the bulk of the costs for their probation supervision ($40/month). In practice, many people have their supervision fees waived due to inability to pay.

^^because of his age and our fucked up alcohol laws, he may have only had HALF a drink and gotten charged for hitting a vehicle that was STOPPED in a TRAVEL LANE on an INTERSTATE at 3AM

You're demonizing this guy and comparing him to someone else who IS a serious fuckup without actually knowing the story.

So you are saying that you disagree that a 19 year old should be able to drive after drinking, even if it's only one beer?

Yeah it was dumb luck the way this went down but I'm glad he's getting charged to teach him a lesson. Drinking underage is one thing but driving after consuming even just half of a beer and driving safely to his destination can lead him to thinking next time after consuming 3 beers "oh I'm straight to drive" and then next time after a six pack. It's a slippery slope especially for a 19 year old that clearly has no respect for the law.

I'm not going to sit here and tell you that I don't think it's stupid that you have to be 21 to drink. But I will sit here and say that if he is going to break to law and drink underage,he doesn't need to be out driving afterwards, even if it is only "HALF A DRINK"

NTSB has recommended lowering the BAC level to .05, which is only 1-2 drinks. Maybe they should focus on stopping everyone > .08 first.

^ Completely ridiculous. I want to know what % of traffic fatalities are caused by people in the 0.05%-0.08% range or even the 0.08%-0.10% range. From my observations most DUI related fatalities are caused by some asshat driving 70mph in a 45 zone with a BAC of 0.16.

It's been proven that fatigued drivers and dumb asses texting while driving are more dangerous than someone with a BAC of 0.08 minus other mitigating factors.

BTW i'd be completely down for the interlock after 1 DUI, EXCEPT that the whole thing has become a racket. Those with their first DUI must face the stigma, fines, community service, and other negatives consequences. The amount of money and effort it takes to "maintain" the interlock system for those who are required to use one is absolutely ridiculous. I'd rather not support this state sponsored racketing industry. I figure if you get caught for a 2nd DUI (usually when an interlock is mandated) than maybe you deserve the punishment.

Of course any time any logical rationale debate comes up countering (in accordance to adhering to the 8th amendment) any push to increasing punishments and/or lower BAC limits the MADD mommies come out of the word work and cry "THINK OF THE CHILDREN."

Yes drunk driving sucks, is irresponsible, and should be punished but i swear if some people were made dictator for a day that'd make consuming a single beverage then driving punishable by 3 years in prison.



By the way the CNN article cites an anecdote from a truck driver that hit a school bus killing 24 children in KY for championing the strengthening of the current DUI limit. That guy had a BAC of 0.24.......

The worst drunk driving crashes are caused by someone driving shitfaced that does not even know what they are doing.

This "prohibitionist" mentality chooses top criminalize the most minor offenders, instead of punishing the actual problem offenders.

Is it true that a first offense DWI is now a felony?

I can't find anything on it online but my buddy swears up and down they just changed the law a month or two ago.

a first DWI in NC is not a felony unless you kill someone while driving drunk. and in that case you're likely charged with murder or manslaughter and the DWI is just tacked on. for a DWI to be a felony you have to have had at least three prior DWI convictions, in which case you get indicted for habitual DWI, which is a felony.

Speaking of which... Wednesday a drunk guy came around a corner at atlantic and old wake forest and slammed into a school bus, got ejected, died at the scene. I couldnt get into my apt on the corner for like 2 hours cause it was blocked off.

Earlier this month, she was charged with drug possession. Court records also show she was due in court in July on charges of speeding and driving without a license.

The three occupants of the pickup truck were taken to the hospital with minor injuries.

There was a third car involved in the wreck that side swiped the pickup truck during the collision. No one in that vehicle was injured. "
