So I know that my employer is not required to give us 4th of July off. For the past 3 years we have had the 4th or the day preceeding it off. However, my boss decided yesterday that since the business is losing money that we need to be open on the 3rd. I've looked everywhere and can't find anything on this. But if in the company handbook it states that we get the 4th (or the day preceeding it) off, does she have the legal right to decide otherwise 2 weeks before?

i'm sure that in their handbook they also have that they can ammend any of their practices at any given time based upon the needs of the company.

I dont know anything about the company you work for or your job, but based on the info you've provided, this seems like a ridiculous thing to bitch about.

If your managers/owners have decided that they need the potential revenue from the 3rd, its probably with good reason.

It always sucks to lose a day off, so I can sympathize, but trying to fight something this stupid using "legal rights" is a good way to get black balled. Maybe having the attitude of "What else can I do to help us bring in more revenue?" would go a long way with your company.

Shouldn't the fact that the company is loosing money, and you may not have a job soon, be the concern?

Put on a fake moustache, walk into your bosses office, and say, 'My name is so-so from NBC/CBS/ABC/FOXetc and I'm a news reporter who received a call from OMFGPlzDoMe who had this experience with the company. Then I'm going to say 'Look....times are tough right now and we know that and don't want to get anyone fired or in trouble because let's be honest here....jobs aren't easy to find especially with a 'mark' on your references so we decided to let you and your company solve the issue with OMFGPlzDoMe and we won't go forward with the story...which in these economic times could be a disaster for your company'.

This is the worst thing to happen in the history of the world. You can't just take this lying down. You have to do something. Preferably involving fire.

Yeah. Lousy job markets kinda create the environment where employers can "abuse" their employees.

On the ohter hand...

Not getting the 3rd off isn't that big of a deal but I've got to think about how much difference that one day would make, considering you'll have a bunch of disgruntled employees filing in... on a Friday no less. I've got to think that their productivity wouldn't be too high that day. It might even effect morale for weeks. Oh well.

check your employ handbook or employment contract.

That being said, in the adult world you do what needs doing to get the job done for your customers (especially if your company's needs the money).

and even if your industry has a fine job market, you don't want to be moving jobs because you didn't get the 3rd off.

To all those that think they know

I would not quit my job just because I didn't get the 3rd off. However, I would quit my job when I've been required to work overtime w/o overtime pay, the boss says we are broke and then buys a $20,000 car, and the fact that I am now doing the job of the 2 other people that quit 3 months ago with no raise in pay

Times may be tough, but I'm not that hard up

oh now the grips about the job come out. you didnt mention this first b/c you looked like an idiot bitching about not having the day BEFORE a holiday off. After you got called out you try and cover your tracks with this OT w/o pay bullshit and your bosses hot $20,000 car. Maybe your company is broke b/c he prolly wanted to buy a $50,000 car.

My boss was nice enough to say not only could I take the friday before or monday after off, if I decided that I didnt need either day off I could simply take another day off at anytime to cover that day. Also I will be paid for said day. I feel sorry for your loss.

This is funny. Your company is losing money but sure your job field has tons of openings right now.

The hell is wrong with you? You're very lucky you haven't lost pay. Everybody's working harder in these tough times and have had to do the work of 2 or 3 people because their coworkers got fired.

Working overtime is the norm in most fields in the US. If you're salaried you tend not to get overtime. That's kind of how it works in the private industry, so it's tough luck if you didn't realize that when you signed on for your job. If you're hourly you are supposed to be paid overtime, and I believe your employer would be liable should they be withholding wages. Chances are, though, that you aren't owed overtime and are just bitching about having to work more than 40 hours a week because it wasn't the norm when you started there.

Again, tough luck. If your field is so healthy and just swimming with job openings then why not quit and go work for somebody else?

Most companies follow the banks. Banks will be closed on July 3rd this year. No point in being open unless you do shipping or take phone calls day, the monetary part will be at a stand still for the most part.

From the Department of Labor instead of jokers on this site:

Quote :
"The Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations or holidays (federal or otherwise). These benefits are generally a matter of agreement between an employer and an employee (or the employee's representative)."

http://www.dol.gov/dol/topic/workhours/holidays.htm

It's at this point that I agree with the jokers on this site. STFU and get back to work.
