A proposed Settlement has been reached in a class action alleging that AT&T Mobility’s flat-rate Early Termination Fee "ETF" ( generally between $150 and $175) was unlawful. The Settlement resolves several other cases that challenge AT&T Mobility’s flat-rate ETF. AT&T Mobility strongly denies any wrongdoing, but has agreed to settle to avoid the burden and cost of further litigation. The sole purpose of this notice is to inform you of the Settlement so that you may decide what to do.

A Class Action Settlement Could Affect Your Rights If You:
• Subscribed to wireless telephone service from AT&T Mobility LLC (“AT&T Mobility”) or its predecessors and paid or were charged a flat-rate early termination fee (“ETF”) at any time after January 1, 1998; or
• Your contract included a flat-rate ETF provision at any time after January 1, 1998.

and ^.. half? hahahaha.. try more like 80%. try to find the paypal lawsuit a few years ago. it was like a $10M settlement and 8M of it went to lawyers

^ any member of the class can object to the settlement or the attorney's fees. Or if they can be excluded from the class and pursue legal action independently.

Most people go "oh shit, I get {insert pittance here} and I don't have to do anything" without bothering to realize that pittance is actually compensation for damages far in excess of the settled value.

I have ATT for my cell service, but never paid an ETF. Can I get in on this?

this may be a stupid question, but i can't find anything on the settlement site that specifically addresses it (CRU = corporate responsibility user):

we have a business contract. it says

"...prior to the expiration of the applicable one-year or two-year CRU term, a cancellation fee of $175 may be assessed against the Customer (each a "Cancellation Fee"). For Service committments beginning on or after May 25, 2008, the Cancellation Fee will be reduced by $5 for each full month toward the applicable CRU term that the CRU completes."


does the part in italics mean that ours is a prorated thing and we therefore do not qualify for this settlement?

we haven't paid any of those fees, but if apple announces today that they're dropping exclusivity with AT&T, then we're going to Verizon.
