ok so another friend got in a wee bit of trouble he was driving and hit some ice and took down a mail thingy so the people behind him called the cops and told the cops that he was speeding he says he wasnt but the cop came and gave him a speeding ticket, the people who called it in werent even there
1. is this even legal? 2. when he goes to court he should plead not guilty so that the cop has to bring the eye witness. right? 3. we have a right to see our accusers in courty. Right? 4. there is no #4
so what say you lawyers or know it alls 2/23/2010 12:36:54 PM |

Weren't there when the cop came and wrote the ticket is what I'm assuming he meant. I feel that's pretty easy to comprehend. 2/23/2010 12:52:40 PM |

I imagine he got something like an "exceeding a safe speed for conditions" or something like that which is the standard ticket given out for ice/snow/rain wrecks. As mentioned before if the driver accepts responsibility for damages then the DA will usually throw it out. Get either a letter from the insurance company saying they are taking care of the damages or an actual receipt and maybe a letter from the owner saying it was fully taken care of if he pays for it himself and take it to the (A)DA on court day.

He says the cop didnt even know about the mailbox damage, so as far as he's concerned it was only a speeding ticket 2/23/2010 4:09:12 PM |

this is stupid
if it was only a speeding ticket the cop would have to write the speed the driver was traveling on the ticket.
