The search has changed from a rescue mission to a recovery effort at Jones Beach Thursday morning, as two young men are presumed drowned in two separate incidents on Long Island beaches.

An investigation is now underway after a Long Beach sunbather is run over by a police SUV. The victim remains in critical condition Thursday with a broken spine, and now the accident has many thinking twice about allowing heavy vehicles on the beach.

You can see his sandal still sitting in the sand, along with part of a crumpled chaise lounge. The 43-year-old victim was on his cell phone, listening to the radio when police said a Long Beach SUV accelerated suddenly in response to a swimmer in distress.

"It necessitated a very sharp right-hand turn and that would be on the passenger's side, where you do have sort of a blind spot, and the unfortunate individual was in a low chaise lounge and unfortunately got run over," said Long Beach City Manager Charles Theofan.

Theofan said the accident occurred when steamy weather drove hundreds to the beach, which doesn't officially open until Saturday. With no lifeguards yet on duty, extra officers were called in in various vehicles.

"Maybe they can do something about that, but they have to be out here and we've seen them rescue people and help people," said Long Beach resident Steve Fein.

Fein and his family watched the drama unfold and wondered about beach rules and heavy police vehicles.

"I'm on the beach a lot and I always see these big trucks and I always wonder, 'Wow they are like three inches from me,'" said Gayle Fein.

Long Beach does have lighter patrol vehicles and rules keep them in an emergency lane near the water's edge. During the summer season, they may now make changes.

In Miami Beach, policy changed when a police SUV there killed a sunbathing tourist. Now, those Florida officers must patrol on bicycles and all terrain vehicles, limit speeds to 15 miles an hour, and use overhead flashing lights on the beach.

New York State Park Police have SUVs, but at Jones Beach they try to use restricted lane and snow fences as boundaries.

"We keep clear so that if there is an emergency on the shoreline they will be able to respond," said New York State Parks Spokesman George Gorman.

The sunbathing victim, identified as Marshall Starkman, remains in intensive care with a broken back. His family in Oceanside declined comment and they may be hiring a lawyer.

The officer who hit him didn't even know it until he heard the shouts.

In light of the accident, several communities around New York have pledge to re-examine their policies regarding police vehicles patrolling beaches

Good rule of thumb when driving on the beach...never drive faster than children can run...if you're in an area with a lot of people out.

In a preemptive defense of my opinions in the previous and somewhat related thread (see "Trooper Goodnight is a god damn murderer") I believe that this is ridiculous and whoever ran over that guy on the beach deserves to become jobless and policies need to be changed about how fast people can drive on the beach when chasing speeders after people who are drowning

Why the fuck would they be using SUVs on a beach in the first place? Seems like an ATV or a motorcycle would be entirely better-suited for the job anyway, regardless of speed limitations.

Motorcycle? I don't think so, definitely ATV though (although it's harder to transport injured people off the beach on the back of either of those)

Usually the lifeguards are on ATVs and the cops use SUVs. You can't really transport someone to jail on an ATV.

I think the guy should be fired. Sounds like he's just a bad driver who is unaware of his surroundings. I don't buy the bit about him not being able to see the guy because he had to make a sharp right hand turn. He should have seen him the whole time he was approaching the guy, long before making the turn.

But if you're a cop, on the job, you can commit actual crimes [negligent battery, or whatever]...
...and not only would you get away with the crime, you'd likely keep your job!

Nah the cop doesn't need to be fired, but he should probably learn that driving fast on a crowded beach is never something that should happen.

Kids go running to the ocean not looking for cars, because they are on the beach.

That could have easily been a 4 year old kid running to get a bucket of water to fill up the hole he dug.

I think this is just an example of a cop that isn't thinking about all the civilians around when he is called to an emergency. There is no reason to cause another emergency by trying to get to one.

Not all cops are guys that were losers in high school that are trying to get back at all the people that hurt their feelings. There are a lot of cops out there that have inflated egos. We don't hear the stories of the cops that go out of their way to help citizens, we hear the stories of cops that beat guys with no legs.
Situations like this suck, and this guy should probably have to suffer some consequence for his lack of decision making.

Haha, thanks. I think you missed me in that other thread where I said the officer should be sent to prison.

I'm usually the first person to hate on cops (really, I am), but for some reason this just seems like bad circumstances to me. That and the fact that the guy lived as well.

Optimally, I'd have a formal reprimand on the cop's record for driving recklessly, a civil payment by the city to help the gentleman who got injured, and amending the policy.

ATVs can't carry all of the necessary gear to do all aspects of the job. We have a mixture of ATVs and pickups here with the main patrol being ATVs. It is not uncommon though for a pickup to need to quickly get to a location w/ backboards, o2, various other supllies, and even jet skis, and they will go at reasonably quick speeds up and down the beach if they need to and it's safe to do so as well.

Its also pretty hard to miss a large SUV with flashing lights driving on the beach even when you are trying not to pay attention.

Police SUVs don't need to be taken off the beach, but the police who are driving them need to realize that the beach is not a road and people aren't on the look out for vehicles driving up and down the beach.

If you take the SUVs away then people will complain when there isn't one there when one could have been used.

Not really. People sleep on the beach plenty. People are reading, or watching their kids down at the water, they aren't looking to the sides of them watching out for vehicles. Flashing lights on a beach do nothing, especially on a bright day.

It's good that they have backboards for all the spines they shatter on the way to incidents.

I'd be more likely to blame it on circumstance if this were the case. I mean, this dude ran over someone who was sitting in a chair listening to music and talking on the phone. That's negligent as fuck.

And you've got the City Manager pointing out that he was in a low chaise lounge. What else are you going to sit on at the beach? Do I need to pull the deck off my house and carry it if I want to be safe?
