Quote :
"Daryl Fleck was drunk and asleep in his car in the parking lot of his Crookston apartment building when someone called police.

Officers who responded that night in 2007 saw his car keys on the console between the front seats, but found no evidence that Fleck, who was parked in his assigned spot, had recently driven.

The appeals court said that Fleck's keys were "readily available to him," and there was no evidence he was in the car to do something other than drive. That he may not have intended to drive is "immaterial," the eight-page decision said."

I'm against drunk driving as much as the next guy, but I think this is kind of screwed up.

Yeah...if that's the case then people are gonna have to start sleeping in the streets if they need a place to sleep and they can't drive home.

Would they have said the same to the guy if he was in the backseat?

I always thought you could get a DWI if the keys were in the ignition, regardless of whether the engine's on or not.

One of my friends got a DWI after getting his car stuck in a ditch. Cop saw him stumbling down the side of the road, and he was too drunk to argue out of getting a dwi. Keys were not even in the ignition.

^yeah thats def the rule

I'm AstralAdvent and i approved this message.

completely how the law reads.

i took a highway patrol sponsored/taught safe driving class, and the teacher actually told us if we needed to sleep one off in our cars, to leave the keys under the car on the ground or tossed a few feet away where you'd find them in the morning.

wild.

true- we tried passing out in the back of someone's suv once, and it was cold out, so he put the keys in to turn on the heat

cop came by and tried to act like he was doing us a favor by not giving the driver a DUI for it (he was in the back seat, and I was in the trunk area)... we couldn't get a cab (they stopped running) so what the hell did he want us to do?

i didnt read the article, did they state what WOULD be allowed as far as where your keys go?

i mean, he may have just passed out while trying to put the keys in the ignition too. but if they were IN the console in the middle then he'd be safe like he wasn't trying to drive?

i dunno, just sayin

that's conjecture and up to interpretation.

laws work better when they're very explicit, ie, in or out of the car.

Excuse me sir, if you want to sleep in your car, you should put your keys outside. Don't worry, nobody will steal them.

Another example of confusing/asinine laws in action:

I was driving home (Charlotte) from school (for winter break) and had a big hunting knife in one of my bags for a trip I had gone on right before I came home. The back seats had been folded down, and the bag was in the trunk, but a cop who had pulled me tried to say I had access to it and charged me with concealed weapon (even though it was in a bag in the trunk area) - WHAT AM I, STRETCH ARMSTRONG???

^^^^ yes, i did. i was well aware that if you're in a car and have the ability to start driving it and you are drunk that you can get a dui. i thought everyone knew this.

what part of my statement made you think i hadn't read it? there's nothing in that article that is not summarized in the thread title.^

don't know if that's necessarily true

it just means that people from both the right and the left need to realize that there's a set of things that require sensible governance that everybody can agree on
