Brown's sister said she was there when her brother was shot. She said they were out at about 1:30 a.m. Saturday when they approached a group of people -- including the off-duty officer -- leaving Eden's Lounge, a nightclub in Mount Vernon.

"There was absolutely no physical contact," said La-Belle Scott, Brown's sister. "The supposed officer was not in any harm whatsoever. He (Brown) had his hands up to show he didn't have no weapons or anything."

Scott said her brother tried to diffuse the situation.

"My brother tried to approach him, saying, 'Calm down, calm down. All this is uncalled for.' And, the next thing you know, several shots rang out. It was maybe eight or nine shots that rang out, and then, all I know is my brother is telling me, 'I'm shot,'" Scott said.

The officer, who Guglielmi said is a 15-year veteran, has not been named. Police said they are investigating whether alcohol was a factor. The officer declined to take an alcohol breath test.

Police Commissioner Frederick H. Bealefeld III has ordered his senior commanders to oversee the investigation. Guglielmi said the officer was being questioned, which is customary in shootings involving an officer.

Officers typically carry their service weapons while off-duty in Baltimore, but Guglielmi said they should not be carrying their guns if they intend to become intoxicated."

Anyone can decline the breathalyzer. It's just if youre arrested for drunk driving, the way the law is written, it's automatic suspension of your license to refuse the test.

For non drunk driving though, i'm not aware of any law that penalizes you for refusing the test (in NC).

This should be a fun one. What do you think the odds are that an internal investigation finds that the officer "complied with policy" or was "free of wrong doing" or any other internal investigation nonsense?

What do you then think the odds are that public outcry will force an actual investigation by the DA's office which will turn up something completely different when people who aren't police officers are interviewed?

Another fun one... how long before videotape of this incident turns up lost or other important evidence is lost, misplaced, or damaged?

Its only a preiminary report, but it says that the guy was shot 13 times and that 13 shells were recovered. They must have been pretty close for the cop to get 100% accuracy.

What do you expect when you give a HS grad a gun, 30K a year, a car, and shitloads of authority?

We have poorly educated military rejects as cops while anyone with 2 fucking shreds of sense or education is doing something that pays more and involves less risk.

yes, it is fucked up. Sometimes the truth is not exactly what most people want to hear or believe. Let's just say I didn't go to undergrad or grad school with a lot of folks with ambitions of joining the police force.

That being said, there are some good cops out there. For every video that someone posts on here about cops killing pets, dogs, or humans with little or no cause, there is probably a video of cops doing something worthwhile like killing a criminal or protecting justice.

Of course, there are the "cops" that should be renamed Interstate Tax Collectors. Traffic cops should be paid, incentivized, and treated the same as meter maids. Traffic cops are doing little to prevent crime and should be paid accordingly compared to those that are not "revenue-generating" entities.

The marine's fault for physically sexually harassing/assaulting a female stranger on the street.

He shouldn't have been shot for it of course... just should been beat up. So, the cop needs to be convicted of un-premeditated murder.
