why use caps? It just seems unprofessional to me. If you're in the right (as in he was under some flavor of contract/agreement) you've got no reason to be flustered. You get your money or you call in the lawyers, simple as that.

long story short:
1. Hired professional to install 2 more air conditions in my store and signed a contract to install them. 2. Eric sold me two air conditions and put them in my hall. 3. Never came back and he made up high school excuses for 8 weeks ranging from he is busy to "I can't work because I have gout". 4. I have 11 recorded instances of him on txt message claiming to be out here the following day with no calls and no shows.

I've already had 5 companies come out and they're all referrals by people I know and they all give me a different answers.

I want you to try to look at this objectively...First you agree to pay your contractor in beer and now you're attempting to get your money back by faking a letter from a lawyer (and doing a piss poor job of it). And to top it all off you used "Genius Boy" in your screen name.

I know you guys are pointing and laughing now, but nobody is immune to lies. You can cover your ass as much as you possibly can but no single person in here can claim he/she has never once been scammed in their life. There are things in life that you know about and there are things in life that you don't know about. For instance, I work in the restaurant field and also the computer field. I do NOT know anything about High Voltage Air Conditioning (HVAC). It's not my job. I didn't spend my life studying it nor did I plan on having a career in it. I am forced to trust in a professional to tell the truth.
I did my homework on this "professional". He works for a prominent HVAC company, confirmed by calling the company and confirmed because he drives their NICE work van. I took his drivers license, scanned it, and independently confirmed his residence by driving by his house since it's only 3 miles away from me. I spent a full week with him, he showed up on time at the time we planned, was attentive to my concerns, and gave me reasonable answers to my concerns. I had no reason NOT to trust him since he was referred to me by a friend that I have trusted for 2 years and has never let me down. My friend knew him for two years, too, and did work for him on his cars and ensured me he was reliable.
As for the system, I know from experience that my current system slows the overall heat my pizza oven emits into the air but there is not enough heat reduction to overcome it. Again, the final temperature over time increases with the A/C running. Based on the rate of temperature acceleration over time with the A/C off VS the rate of temperature acceleration over time with the A/C on, the rate of increase is reduced by 2/3rds according to my data charts. It made sense to me at the time, that doubling the tonnage of cool air to 6 tons, I would be able to definitely cool the place down. We signed the contract. I gave him the money for the PARTS ONLY, no labor.
The next day he brought the two brand new air conditioning units and I personally inspected them and they look beautiful.
The day he signed the contract he bought (yes bought and paid for) a beer than I recommend called Aventinus Schneider Weiss. When he brought the air conditioners to me the next day, he asked me to order two cases for him. I ordered them and they came in Friday (4 days later).
He came out on Saturday to install the system. They worked for maybe 30 minutes when they came to me in my office and said they couldn't get the system on the roof and that they needed to rent a crane or lift. I said okay. He said he would come back on Sunday and install everything. I told him his beer came in and I gave it to him on good faith since everything has been going smoothly up until now.
After that day, I never saw him again.
===END TL;DR===
Darkone: I have a three page handwritten report by the HVAC guy who took time to explain everything to me and will testify in court on my behalf. I told him if he represents me, since I'm not good at using my mouth (I always fuck up my words), that I will hire him for the job with the money I get back. He only quoted me $1200 and if I win the case, I should have my my $3000 back. If you really want me to I can type out what is wrong with each of the 3 units I have.

GeniuSxBoY, I'm sorry you got scammed. It sounds like you did a reasonable job with your research. The only thing I can really fault you for is working directly with the guy you hired to do the installation instead of contracting through the company that employs him. When you hire someone "on the side" you take more risks since they won't be covered by their business's insurance. Having the guy you hired flake out is one of the risks, but it's actually one of the smaller ones. A bigger risk is that he could have installed faulty equipment, it catches on fire and burns your store down, and your insurance won't cover your losses since the installer didn't have a business license. I've seen that happen.
I know that you've already found an alternate installer, but I really recommend hiring a professional shop who will do actual heating load calculations for your shop and will design a system with the correct cooling load that will deliver air precisely where it needs to go. Anyway, good luck recovering you money. Based on my past experiences, I'm fairly certain that you'll have to go to court. 7/9/2010 11:13:37 AM |

Just for the record, can you verify for me that the cost of hiring a professional company to do an install like you recommend will cost between $8,000 and $15,000?
Had it been successful, I would have only spent $4000. This was my biggest motivation because I had to do something about the heat after 3.5 years. I still didn't have $8,000 to $15,000 to have it done right.
But then again, I can't guarantee it would be done right. I see on the news that contractors scam for far more money than $15,000. Sometime it's in the millions. I didn't want to invest that kind of money for it to potentially fail from being tricked into buying a brand new unit I didn't need and for the company to cut corners like they always seem to do. I didn't install the other units, but the last guy pointed out ALL the corner cutting the last people did. One of my A/Cs is a 2 ton unit with a 2.5 ton air handler for crying out loud.
Anyway, it's not easy and it has inspired me to sign up to classes to get my HVAC license after I get more time.

^^ I can't really say what the cost would be without knowing specifically what equipment would need to be installed and what labor would be necessary to do so. I'd have to call some folks to figure out equipment costs anyway. My experience is just fixing and installing the stuff, not billing people for it.
