isn't it true you can use any legally viable 'escape route'? for example, if you are allowed to make a u-turn in the area that you are waiting, you are allowed to do so w/ no questions asked. of course, you will look like the scum of the earth but yeah

I don't drive drunk, I'm just saying...something about it being a hindrance to people who need to get somewhere in a timely fashion. I don't think they can legally base reasonable suspicion on a legal traffic maneuver, but then again once you've got a DUI who cares what you say you drunkard you

they hang out in places chosen so that you're just driving along happily and then suddenly see all these fucking flashing lights right in front of you

Upheld under state law and federal Constitution. Delaware v. Prouse, 440 U.S. 648 (1979). A trial court has held that a legally executed U-turn in advance of a checkpoint did not justify a stop. Howard v. Voshell, 621 A.2d 804 (Del. Super. 1992).


North Carolina Authorized by statute. N.C. Gen. Stat. 20-16.3A. State v. Barnes, 472 S.E.2d 784 (N.C. App. 1996). State v. Johnson, 446 S.E.2d 135 (N.C. App. 1994) held entering a parking lot to avoid a checkpoint justified a stop. In State v. Foremen, 527 S.E.2d 921 (N.C. 2000), the Court held that is it reasonable and permissible for an officer to monitor a checkpoint's entrance for vehicles whose drivers may be attempting to avoid the checkpoint, and an officer, in conjunction with the totality of the circumstances or the checkpoint plan, may pursue and stop a vehicle which has turned away from a checkpoint within its perimeters for reasonable inquiry to determine why the vehicle turned away.


Now 'reasonable inquiry' is in the eye of the beholder isn't it...if you tell the cop you're late for something, do they let you go against their better judgment?

And usually, don't they have a patrol car a few blocks away to catch u-turners? I mean come on, U-turning to avoid a checkpoint isn't a new trick folks.

well unfortunately the beholder is a cop so they're probably not letting you turn around and leave in a jiffy. and once they come up to your car and say "kind sir why did you try to avoid the check point"

and you are nervous and trip over a word OH SHIT you gonna have to do some sobriety tests.

which is all good if you're sober but then you're just wasting even more time when you coulda just given them your license and gone through the checkpoint without a hassle.

for the record

i hate checkpoints and think they are unconstitutional. but i'm just sayin. i don't make the rules and if you u-turn you're probably gonna get in trouble.

When I was still living in Raleigh there was a checkpoint right past Isabella on Lineberry. I drove up on it, saw it, and turned on to Isabella at the last second, intentionally making myself look suspicious as hell (I live on Isabella). Sure enough, cop comes flying up behind me, pulls me and starts grilling me (at this point I'm in the cul-de-sac in front of my house). I was just like "whatever man, I was just turning in to my neighborhood" and he was sayin something about how that turn didn't look planned at all, I looked like I was avoiding them, blah blah blah and I just let him talk. When he finally let me go, I got out of my car and walked up to my house (before he even left). I hope he felt retarded.

There was one of these getting onto 440 from Lake Boone once. Guy in front of went to pull in, then swerved back out. All I saw were lights, so I thought there was an accident. As I went to pull on the on-ramp, headlights flash on and this trooper takes off after this dude, just missing me.

He was sitting on the side of the on-ramp, in the dark.

Yep. Realize this now. No coffee.

Guy in front swerves all over to avoid check point. Cop hiding in the shadows flies from the on ramp just as I'm about to turn onto it, to chase after said dude. Headlights, blue lights siren all coming at my face. I nearly piss my pants.

Maybe that makes more sense? If not, fuck it.

I was planning on driving drunk through Wade Avenue and hopefully getting into an accident and killing people, and now that you've prevented me from being caught and punished for my idiotic behavior, I can now take a detour and hopefully hit and kill someone else. there are checkpoints on wade all the time, i can only presume that it was the spot right past whole foods as you get towards the belt line ramps.

checkpoints are also frequently at chatham right as you go down the hill and enter cary. about 1 mile past wolf village. Another frequent spot is Capital blvd right at the 401 split. basically they're trying to get people who are clearly driving far distances and are under the influence. that appears, to me, to be their major concern.

Oppose in all situations.

You can never prove that someone is 100% guilty, and if one person is wrongly arrested for DUI (which has clearly already happened) then it should never happen ever again.

Besides, it's more expensive to arrest someone for DUI than to clean up a car wreck.

It seems quite possible to me that someone who would otherwise have driven under the influence could have seen this thread and decided to just stay home or take a cab. In that respect, this thread could be viewed as a public service.
