i don't really get how it is trampling on people's rights when it is a state of emergency

but i know other people are all like rawr rawr grumble grumble

it will be over in a few days

you can use your guns then

until then you'll just have to combat the hurricane and the grocery store lines for bread and milk like the rest of us

dove season opens saturday. the dove season is like the hunter's new year. it's the first season to open up. dove hunting on opening day is a tradition for a lot of people.

most of the state is not in a "state of emergency"

besides, i don't see the advantage to having the law-abiding citizens unarmed during a state of emergency

i think they do it to prevent worst case scenario (think katrina) type deals. like when shit really hits the fan and people are rioting and looting in the streets and no one can find food. desperate people resort to desperate measures so i guess they're trying to prevent the absolute worst (and prevent the gun holders from just taking the law into their own hands, if shit like that were to happen)? but that is just myyyy thought.

and then you can exercise civil disobedience and become part of a lawsuit to challenge the constitutional aspect of this law.

yeah, this law is fucked up, and if I felt inclined to carry one of my guns anywhere, I wouldn't let it stop me, and I doubt that it's enforced. furthermore, the kind of wild scenario that this law is meant for is the kind of scenario where you can bet your ass that I'd be armed, regardless of what the law says.

that said, the thread title is completely disingenuous.

lol so all the decient people will be unarmed, let the robberies and and muggings begin.


during Ike here, the city gov't here stopped the sale of alcohol and ammo for 2 days after the storm passed. but the gave us a warning 5 days in advance. my hurricane supplies now include ammo, and at least 5 cases of beer per person. i bought 2 cases of beer thinking it would be enough for me, i was out the 1st day...

The Constitution overrules this stupid state law.

And yes, people have been bitching about this for a long time. And you can blame Bev, just like any other governor for suspending gun rights... they have the ability to get the law changed and they don't.

Well, let's just prevent any worst case scenarios and have the police search everyone's home for any thing that could be used as a weapon and then have a police office in everyone's home, just to make sure.

(1) temporarily or permanently seize, or authorize seizure of,
any firearm the possession of which is not prohibited under
Federal, State, or local law, other than for forfeiture in
compliance with Federal law or as evidence in a criminal
investigation;
(2) require registration of any firearm for which registration
is not required by Federal, State, or local law;
(3) prohibit possession of any firearm, or promulgate any rule,
regulation, or order prohibiting possession of any firearm, in
any place or by any person where such possession is not otherwise
prohibited by Federal, State, or local law; or
(4) prohibit the carrying of firearms by any person otherwise
authorized to carry firearms under Federal, State, or local law,
solely because such person is operating under the direction,
control, or supervision of a Federal agency in support of relief
from the major disaster or emergency.
(b) Limitation
Nothing in this section shall be construed to prohibit any person
in subsection (a) from requiring the temporary surrender of a
firearm as a condition for entry into any mode of transportation
used for rescue or evacuation during a major disaster or emergency,
provided that such temporarily surrendered firearm is returned at
the completion of such rescue or evacuation.
(c) Private rights of action
(1) In general
Any individual aggrieved by a violation of this section may
seek relief in an action at law, suit in equity, or other proper
proceeding for redress against any person who subjects such
individual, or causes such individual to be subjected, to the
deprivation of any of the rights, privileges, or immunities
secured by this section.
(2) Remedies
In addition to any existing remedy in law or equity, under any
law, an individual aggrieved by the seizure or confiscation of a
firearm in violation of this section may bring an action for
return of such firearm in the United States district court in the
district in which that individual resides or in which such
firearm may be found.
(3) Attorney fees
In any action or proceeding to enforce this section, the court
shall award the prevailing party, other than the United States, a
reasonable attorney's fee as part of the costs."

This is the same governor who said she was applying for federal disaster aid the last time is snowed. In the end the snow melted in a day, or two and everything went back to normal. She seems to think anything beyond sun and a little rain is a disaster.

and yes there are some particularly stupid people in this thread (B4C, etc.) bitching about how a state of emergency is overkill, and they would be the first to scream and shout about unprepared government as soon as Earl takes a turn inland and devastates half the state.

i don't blame her if she applied for disaster aid on a clear, sunny day. the feds take a bunch of money, then redispense it as they see fit. I'm no fan of Gov. Perdue, but I can't blame her for trying to get back dollars that never should have been taken to begin with.
