Beware this place. They will fuck you over. Words.

My fiance moved out in July, and notified Progress Energy that she was moving and to cancel her service there. Since her lease ended on August 7th, the Beckanna said she had to maintain service until that time. Fine. They said they would notify Progress on the date her lease ended to transfer the service back to them. They didn't.

So now, she's stuck with the bill for the last month. There hasn't been anyone assigned to that unit, but they have been showing it to prospective tenants. Judging from the bill, they have had the AC on full blast. Since I pay our bills, I told them that the power bill for the last month was their responsibility. We had turned everything off when we left, so they must have turned it back on. They deny any liability for the bill, even though they have been the ones using the power in there. To top it off, they are over a month behind on reimbursing her for her deposit, even though they agreed that the unit was in impeccable shape. They have routinely given her the run-around on the whereabouts of the check, with each person saying something different each time.


They apparently like fucking other people over, too. One of my fiance's friends had complained about her sliding glass door being broken when she moved in, which they never fixed. When she moved out, they billed her $300+ for it, saying it must have been her fault. She even confronted the woman she had spoken to about the door, and the woman said the had no recollection of the repair request. When shown an email verifying it, the woman said they couldn't honor it because the email could have been fabricated.


Long story short, don't stay at the Beckanna. They will fuck you over.

I dropped the whole "You'll be hearing from my attorney" line, and they said that since my name wasn't on the lease, they didn't care to hear from me. So my fiance repeated exactly what I said, and said that they would be responsible for any attorney fees accrued. All they said then was that if that was the case, then they would no longer be able to speak to us, and that their legal team would determine whether to "deal with us or not". Something about them feeling like they were being "attacked".

Man up, be professional, and take responsibility.

Thats illegal. In NC you have 30 days to either return it or explain why you won't.

Is it managed by a larger company? I'd assume that their "legal team" is one cheap lawyer who may or may not be on retainer.

my fiance lived there before we moved in together, and she never had any problems - other than the elevator on her end of the hallway breaking occasionally

Small claims court

No sense in dealing any further with them or their 'legal team' in any other way

It's SOP for just about any business to cut off direct contact once the threat of legal action has been levied. It limits their liability.

Small claims court is your friend in this situation so long has you have some sort of documentation that the deposit is past 30 days due and that they accepted responsibility for the power use.

yeah, in all honesty, this is another example of why you need paperwork for everything you do, and if you don't and it comes back and bites you in the ass- well it's a hard lesson learned in the journey to adult-dom

I had a similar situation with a landlord not returning a $1800 deposit to three roommates and I.

I ended up going to a lawyer who got me out of a speeding ticket a few months earlier and asked his advice. He sent a letter threatening legal action and they promptly returned our deposit.

Generally it's cheaper for a company to eat the cost than to pay lawyer fees.

I have an attorney buddy downtown. Sounds like all I need is for him so send a letterhead threatening some foot-to-ass resolution if she doesn't get her money back.

At that point they can either return your money or pay their attorney $200+ for the hour it takes him to write a response, beyond that they'll just be losing more money than they would be by paying you back.

Especially now that they're violating the law by waiting more than 30 days on the deposit.

Mr. Josh is right, that shit's made illegal. They have to return the check or give you an **itemized** list of each deduction from the deposit. They are allowed to give you a temporary one by 30 days, but after 60 days they have no legal recourse and money will be returned to you.

I literally just sued my old landlord on this same statue and won.


also, funny story. My friend used to live in that shit hole after he inherited $30,000 which he blew in a month, and he trashed the fucking place. had people spray paint the walls with "grafiti murals", etc. never cleaned the carpets the whole time he lived there, had 3 people living in a one bedroom place. ended up just bailing on the lease and nothing ever happened.

the Beckanna is EXTREMELY desperate for people to live there. that place has to be going broke

my sister's house is rented out in Boone to some kids. Well we haven't given their deposits back b/c they punched wholes in the wall and shot bbs through her artwork(it was of a dog) that was there. Now thier bitchy mom calls saying she wants the "whole deposit refunded"

^not in writing. they are trying to asses how much it is. There are alot of other problems too.

they also broke the door jamb and frame, but they fixed that. I mean who tears up a relatively new house like that???

I am not looking forward to moving out of my place because I have a feeling they may try to keep my deposit for damaged carpet even though it was damaged because it sort of sucked in the first place, and also it's been 3 years since it was put in and I am pretty sure they have to replace it anyway to legally rent the place again. I'm hoping they will just not care.

another example of them not being too bad- my gf ordered something from a place she had an account with, and they accidentally sent it to her old address (beckanna) 6 months after she moved, and they still forwarded it along instead of just refusing delivery


i still think this is a lesson to be learned about getting everything in writing

Yeah...just get an attorney to write a letter threatening small claims action unless the matter is resolved on your terms in a short amount of time. Have them cite the landlord/tenant law with the 30-days language.

Landlord/tenant law favors the tenant....but landlords will bully the tenant til the tipping point. Lawyer up or go ahead and file in small claims.

you might be screwed on the electric bill thing. You can set a date to cancel service at any time. When I left my apartment, I had a similar thing, so I just called the electric company and told them to extend the service to the date my lease ended. I mean, it sux that they would tell you they would transfer service, but unless you got that in writing, then you are fucked, and I doubt there is much you could do.

I mean, you might be able to hint that since they are being shitty in returning the deposit, they are also shady in other areas and might do such a thing, but it would be circumstantial at best and be a he-said she-said thing.

yeah the electric bill is all her fault.

granted these people sound shady as hell, but it was her account and was ultimately her responsibility to ensure that her account was closed on the day her lease was up. If they said they were gonna take care of it, fine, but still call to ensure it was done the day after the cut off date.
