Never heard of this since Barker would take it up until midnight but there's a sign on the paybox that says rent was due at 5pm. Website and their official Facebook page plus other websites say no office hours on saturday or sunday. Lease says end of business day.

So I ask you TWW, how can 5pm be the end of a nonexistent business day?

i like waiting till the last minute. there's no benefit to turning your rent in early. i'll wait to see what excuse the landlord has and then send him the screenshots saying they're closed and he can point to the pertinent part of the lease he thinks applies at 5pm.

I've had something apartment-related due on a holiday where they didn't have office hours. The office just said as long as they had it at the start of business the next day they didn't care. Maybe that will work for you?!

I mean seriously, it's not like they're going to log your rent and get deposits together at 7pm anyway.

if they tell you the rent is due at 5 pm on the 5th

then it sounds like it's due at 5 pm on the 5th

lol that looks like one of my female professors with a beard

they told me its due at the end of the business day, of which Sunday is not one of them and T-Thur they are open till 7:30pm

the SIGN says it was due at 5pm

5pm on a weekend = 5pm on the friday before that weekend starts

you can't just put terms in a contract that aren't already covered by the plain language

"end of business on the 5th" can't magically turn into 5pm on the 3rd because you think it makes sense (or because thats what they MEANT to say)

also the grace period exists for the sole purpose of giving a few days in case the DUE date lands on a weekend or holiday, it has absolutely nothing to do with the late fee date, a five day grace period is a five day grace period always

If it's due by the end of business on the 5th, and there is no business on the 5th, then if they wanted to push the point it is due the last time there is business before the 5th.

Actually, with NC tenant law it looks like you are probably fine in any case since there is a statutory 5 day provision.

That said, just drop it in the slot and with most landlords you will be fine. Since if they are out all day on Sunday they won't know whether it was before or after 5pm, and they can't do anything with your check before Monday morning anyways.

actually, it was probably due on the first, but they graciously don't penalize you as long as it's in by the 5th

yeah rents are almost always due on the 1st and then you have the 5 day grace period (although technically a 5 day grace period would start at the end of 1st and go through the 6th but i learned a long time ago that people never count days right)

^ lol, i'm actually getting the end of business day part from the lease NOT from my personal preference, obviously if it just said the 5th it wouldnt be an issue, plz read carefully before replying

it's not like this is the first time the 5th has ever fallen on a weekend. you knew they were going to be closed on the weekend so it's your responsibility to get it to them before they close their offices. you can't get mad at them if you didn't pay them when you were supposed to and they fine you.

you've all just reminded me of an old boss who used to think that if i worked for 7 days straight i would end up on the same day as I started on the 7th day.

so now I ask TWW, if rent is due on the 1st (therefore not late), and I have a statutory 5 day period, doesn't that mean i have till end of business on the 6th?

SO glad my apartment "allows" you to slide a check under the manager's door up until the morning of the 6th. They used to have a drop box, but got rid of after the remodel. There's been plenty of times where I didn't have the money (b/c paycheck didn't deposit on time)....just like. I'm contemplating if I should avoid late fee by submitting check, and hope it doesn't clear until Thursday OR wait until Thursday and pay online when I for sure have the money but have to pay a 5% late fee. *sigh*

my strategy in college was just to devote parts of each of the 4 checks i got each month (2 if you get biweekly) to rent, that way i wasnt counting on one paycheck to make or break it

If the due date lands on a day in which the office is closed, you may pay the next business day without penalty.

For instance:

Sales tax is due on the 20th of every month. If the 20th falls on a Saturday, then the due date is the 22nd.

Exemption:

When the contract explicitly states that you have to pay before the due date.

I honestly dont think this should be an issue. If rent is due on the first, then give it on the first.

Don't look at it as being due on the 5th.
