Davidson County farmer beats a Fox8 News cameraman with a stick for trespassing on his property. God I love North Carolina

Is there any proof that the cameraman was on his land though? He said that he was on the side of the road but who knows. Still, that guy was freaking pissed off. He could just been like "Hey dude, get off my land, you're trespassing." But then again, logic doesn't apply to rednecks.

I don't think it matters. If someone steps in your yard and isn't threatening you, do you think that gives you the right to beat him with a large stick?

If they refuse to move and are completely unreasonable, then yes (although you would still prob get charged with something). I do think I should be able to physically move them somehow. However, unless they were doing something harmful... IRL I would just call the poh-leece like a sane person

^ too many variables, we aren't really disagreeing here. You can see in that video that the redneck was NOT behaving reasonably, which is why he was charges with 2 felonies.

Yes, but I would disagree with charges if the reporter was in the middle of the dude's field and refused to leave after several warnings. The way it happened in the video, I am totally on the reporters side.

Poor cameraman probably was concerned for how much that equipment cost the station, cause unless you have a good reason like not wanted to get fired for dropping a $10K camera who else stands around and lets anyone get more than one lick on you with a little stick like that? At least now he has a tape he can sell for $500 to trutv for their next "outrageous: caught on camera" special.

Is the video admissible in court ? Clearly he didn't want to be filmed. This goes back to my support of Texas trespassing laws but if the guy crossed a fence or entered any sort of access restricted area on someone's property I would want him to know he could lose his life for it just to deter them from doing it. I don't think I could/would shoot someone but violation of privacy and property bothers me and I think shot on site laws would stop a lot of stupid crap from happening, from vandalism to robbery. I think if I owned a farm and I saw someone filming on it without permission, I'd be pretty upset but only after they crossed a fence or something.

"No" is the correct answer. Even if an individual is stealing from your property, so long as they present no threat you CANNOT legally hurt them. The only exception to this is to prevent a forced entry, assuming you are INSIDE the home (From my interpretation of the law, this does not count if you're outside the home preventing them from entering). If you are inside the home and someone is in the process of forcing entry, you may use lethal force to prevent said entry. Once they're in the home, if you haven't shot them yet and they say, "I'm not here to hurt you, I just came here to steal some stuff", you have no legal right to lay a finger on them in NC.

Trust me, I'm all for being able to shoot robbers and vandals, but a shoot on sight law is downright asking for slaughter in some places. Imagine someone like this guy, who thinks that an easement is HIS PROPERTY. If he knows he has the right to shoot someone simply for stepping on his property, you damn well better believe he will do so if he THINKS you've crossed the line. Even if he isn't in the right, he can't take the bullet back later. He will shoot you because he believes, at the time, that you are on his property and he knows he's allowed to shoot trespassers.

The problem here is that the simple misinterpretation of property lines on your part OR SOMEONE ELSE'S (Like this guy) could easily get you killed were such a law to be enacted. Even I, the psychotic gun and knife freak, can admit that something of that nature is going WAY too far. Legalizing shooting someone to stop theft and/or vandalism, perhaps. Legalizing shooting someone for stumbling across an imaginary line which may not be clearly marked or even exactly known by the property owner? Think about minor property disputes and property line fuckups. Both owners may believe some strip of land is theirs. All it takes is one crazy owner thinking they have the law on their side in such a matter. Such a law is just asking for trouble in my opinion. Not that it can't happen when it's illegal, we all know that's not the case. However, I do feel that legalizing the killing of non-violent, non-crime committing (Other than the simple act of coming onto property which isn't theirs) trespassers is an extremely dangerous move.

OK looking at this from a different angle,

Google is facing tons of lawsuits right now for all the crap they shot (and picked up on wifi) when they did street view. If you are taking pictures for a commercial (or personal) reason of my land, theres a good argument of it being trespassing. And as sumfoo1 stated, the guy has a right not to be filmed. TV crew is facing a lawsuit right there as its already been put on the news.

Easements... theres a lot of flak on them always anyway. Mostly as the state/local govt claims them but wont take care of them.
