There are major concerns about the way the search warrant was carried out. Kennedy argues that the search warrant was overly broad and lacked probable cause. But beyond that, the warrant was only valid in Luna County, where Deming is located. The Gila Regional Medical Center is in Grant County. That means all of the medical procedures were performed illegally and the doctors who performed the procedures did so with no legal basis and no consent from the patient.

In addition, even if the search warrant was executed in the correct New Mexico county, the warrant expired at 10 p.m. Medical records show the prepping for the colonoscopy started at 1 a.m. the following day, three hours after the warrant expired."

Young is taken to the Gila Regional Medical Center in Silver City, and just like Eckert, he's subjected to medical procedures including x-rays of his stomach and an anal exam.


Again, police found nothing, and again the procedures were done without consent, and in a county not covered by the search warrant.

We've learned more about that drug dog, Leo, that seems to get it wrong pretty often. He might be getting it wrong because he's not even certified in New Mexico.

If you take a look at the dog's certification, the dog did get trained. But his certification to be a drug dog expired in April 2011. K-9s need yearly re-certification courses, and Leo is falling behind.


"We have done public requests to find anything that would show this dog has been trained, we have evidence that this dog has had false alerts in the past," Eckert's attorney Shannon Kennedy said.

The doctors from the Gila Regional Medical Center have been turned over to the state licensing board. It's possible they could lose the ability to practice to medicine.

And the police officers will be answering to a law enforcement board."

I think it's looking more and more like I was correct months ago when the story about the NSA's new data center broke, before any of the Snowden-driven controversy happened. I think the NSA is collecting or at least planning to collect everything. Every email, text message, financial transaction, credit-card swipe, etc.

There must be a way to ride this anti-surveillance populism to political success. It's too damn popular not to succeed. I'm still hoping for some anti-establishment type with some big balls and a stomach for politics to take up that fight, and no, Justin Amash does not count.

Yeah, that link is misleading. They were found NOT guilty. Somehow. Granted I didn't sit through the trial and see the case the defense presented but I'm often amazed at how juries can reach their decisions.

Thankfully or regretfully depending on your view of double jeopardy there's the potential for a second federal criminal trial and additionally potential civil suits.

^^ seems like a tad bit overdoing it, but they didn't kill the dog, or seem otherwise too trigger happy.

I think it's odd they're harping on the gun permit -> requires more measures train of thought by the police.

They probably presume anyone might have a gun, but they had good evidence to suggest there was PROBABLY a gun somewhere, and it seems like really good preparation on their part to consider this possibility.

Guns pretty much make every situation more sensitive, the cops were aware of this, and they did what they had to do to protect themselves. Makes sense.

Knocking on the front door and waiting for someone to answer makes sense.

Making arrests outside the home makes sense.

It does not make sense to break down doors with guns drawn to arrest a non-violent suspect for a non-violent crime.

That was a 3 hour ordeal. It started w/ beat cops, then crisis intervention (officers trained to deal w/ people having a mental crisis), and finally after threatening to kill everybody, SWAT came in. He had a history of stabbing people and even says that if he wasn't on a mountain he would kill the police.

Were the police suppose to just let him walk down the mountain after refusing to cooperate for 3 hours?

He picks up the knife, blades off and is shot. Now remember, it takes time for your brain to process what is happening. So by the time he is armed, blades off the decision to shoot is made; where the shots land are after that are the aftermath of movement.

People get shot in the back, its a fact of life. There is nothing that says you can't and even as an armed citizen, if you aren't prepared to shoot someone in the back, you shouldn't carry a gun.

So they don't shoot and he walks off and stabs someone, what then?

As far as after shooting the guy. They don't know if he is faking it or is dead. The threat is not over till everyone is safe. You send the dog; the dog is a tool to determine if he is dead. The fire bean bag round in the ass (that's a pretty soft muscle) again to determine if he is dead.
