SUBJECT:
Peer-to-Peer (P2P) Copyright Infringement Notification on the Nomad Wireless Network


At the end of spring semester 2011, NC State University will begin forwarding notifications regarding purported peer-to-peer (P2P) copyright violations on the campus Nomad wireless network to alleged offenders.

NC State is required by the Higher Education Opportunity Act (HEOA) of 2008 and the Digital Millennium Copyright Act (DMCA) of 1998 to implement procedures, including technology-based deterrents, to prevent unauthorized distribution of copyrighted material (music, movies, videos, games, software, books, and other files) via P2P applications or other means. The university currently receives monthly more than 300 P2P DMCA notifications by various copyright holders.

The university will take the following actions when notified of alleged copyright infringements occurring on the campus network. Incidents will be automatically referred to appropriate campus officials in Student Conduct or Employee Relations, and steps will be taken to help the individuals stop unauthorized downloading or distribution of copyrighted materials. Repeated copyright violations may result in disciplinary actions at the university for a student or an employee and may serve as evidence in court. Such a record or finding could adversely affect a student or an employeeÆs current status at NC State, as well as future employment or educational opportunities.

In order to both protect and inform campus network users, the university is investigating ways to provide more proactive warnings to individuals regarding P2P activity for which they can be held liable. These improvements are expected to be piloted in fall 2011.

Under federal law, civil and criminal penalties for copyright infringement include:

- Anyone found liable for civil copyright infringement may be ordered to pay either "actual" damages or "statutory" damages affixed at not less than $750 and not more than $30,000 per work infringed.

- For "willful" infringement, a court may award up to $150,000 per work infringed. Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense.

- A court can, in its discretion, also assess costs and attorneys' fees.

haha yeah i read that earlier... good thing i live off campus and i own all my music and only trade with other people who own it and want backups. lulz

I wonder how many people in the RIAA go to concerts and buy merch from bands?

That sucks, though it doesn't seem much different from was in place before, just possible disciplinary action.

I got busted for downloading an episode of Entourage a long time ago. Scary letter from a lawyer but no further action was taken. My friend got busted for downloading 'The League of Extraordinary Gentlemen.' Again, no thing happened, but if it had, I told him that's a bad way to go down for downloading a crappy movie.

I thought it was like a warning if you are busted and then if they 'detect' activity again then they won't defend you (send the RIAA some of dat $tution)

I got that email back when I was in school along with about everyone else I knew. Delete your P2P client and back up all of your music on an external hard drive and clear your computer. They talk to you and once you delete the P2P they do nothing. Scare tactics only

Are you coming to my underage drinking, statutory rape, domestic violence coke party? It starts Off Kaplan at 10:00 PM on Friday, April 29th, 2011. Please don't mention it to anyone outside of this thread because the activities we will be participating in will be highly illegal and could result in multiple arrests should any law enforcement find out.

i wonder if people still run top sites on campus - back in 2000-2003 or so the ones i remember are mwm (arguably the best mp3 top in the US - run by an employee) - ldh - tvx - fon - maybe ak
