The report clearly says that he was mentally unstable....for someone with mental issues pointing something that looks like a gun, I'd be hesitant to shoot at him.

If a guy has a history of being mentally unstable and appears to be holding a gun to an innocent persons head, shooting them is exactly what you should do. Had they not shot him and had he had a gun and shot the hostage people would be bitching because the police let an innocent person die.
