I doubt I'll get into this as much as the Brad Cupper trial. But it needs it's own thread. QUIT RUINING THE MISSING RUNNER THREAD WITH JASON YOUNG COMMENTS!!!1

So first impressions. Guilty or not?

I'm leaning towards guilty as a gut feeling. But I haven't really payed attention to this case. Other than I lived about 2 miles from their house when it happened.

I'm thinking he's probably guilty too. I think the case against him will be stronger than the one against Cooper.

Seriously? A fucking gas station clerk is going to remember one customer from 5 years ago.

Guilty.

But I'm sure the internets will declare him innocent because of an inept murder investigation, an unfair trial and their SOP contrarian/cynical attitude.

If he was an incredible dick, then yes. NTM it's not like they just asked her about it yesterday. This case was investigated a long time ago.

Not a good sign for the defense.

Who beats a pregnant woman to death? That is just really cold.

Yeah, for a little while. The murder was 5 years ago, but the police probably got the clerk's testimony a long time ago. I'd be interested to know how much time passed between the murder and the time the clerk identified him as a customer that morning. Any significant time and it's definitely suspect.

I've got to think that even with a confrontation I'd forget the face within a day or two, considering I was serving people day in and day out. I might remember the face for a while but one thing I would definitely forget was the time and day. After any significant passage of time the days would all bleed together. At least for me.

There's a huge difference between the cops showing up the week of and asking did you see this guy Sunday morning and them showing up months afterward and asking did you see this guy on January 17th. "Why yes officer. At 5:13AM if I recall correctly."

Seems if you were trying to establish an alibi, it'd be a good idea not to be a dick to someone that could ruin your alibi by remembering you being a dick.

^^^^the gas station may have a log for such incidents

we had one at the bar.

when a customer is overtly rude or too drunk or there are any problems we would write down the persons name, date, time and what happened.

well they're accusing this guy of brutally beating his 5 month old pregnant wife to death. i'm not thinking mental stability is among his strong suits...especially since it was only 2-3 hours after the beating.

I wonder if the lady remember what he was wearing (probably not). Because the clothes he was last seen wearing via hotel security video (different than the ones he checked in wearing) were never recovered/accounted for. Pretty interesting that one of the hotel security cameras was unplugged for a few hours that night (to supposedly allow him to renter undetected).

^^Or for people that drive off without paying. So a camera inside to catch an image of him and a camera outside that put his car at that station.

So the hotel security cameras were off that night. Wow.

No. A number of cameras have him walking all over the hotel. A single camera was unplugged, and if i recall correctly, it was the one that would have seen him reentering the building if he left and came back...and the manager said that was highly unusual and had never happened before yadda yadda.

There's a ton of details in here:

seems like alot more tangible evidence against this dude...especially with the clerk that blows his alibi

after skimming over the documents, it actually seems like they covered their bases pretty well with the forensics aspect...you know, actually testing relevant items and collecting evidence pertinent to the case.

So the murder was November 3rd and they found the clerk on the 6th. Yeah, the clerk would likely still remember.

I used to live not far from King, worked there for a while one summer while I lived at home. Not surprised if a gas station there doesn't have security cameras. I wouldn't be surprised if that same gas station still had an outhouse and didn't take credit cards either...place is podunk as hell.

First impression is guilty. I can't imagine anyone brutally beating up and killing a pregnant woman for shits and giggles. Nothing was stolen right?

I would probably have remembered that guy also if he was a complete dick to me. Supposedly though there was some kind of misconduct during the police line-up with the witness who identified him?

apparently they showed only his pic instead of the standard lineup to choose from...but she was so adamant that it was him it likely didn't matter in this case.

Although there have been instances of false id when people were questioned in this manner, which is why the lineup is sop

I'm assuming that the police went from gas station to gas station starting in VA and ending in Raleigh holding up a picture for all the clerks asking 'have you seen this man?' How were the police supposed to do it in this case? Take 5 pictures and ask 'have you seen one of these 5 men, and if so, which one?'

Yeah they were doing basic investigating, not even disclosing why they were looking for him and the cashier volunteered that she had seen him.

That is different from doing a flawed lineup when the person already knows they are trying to pick a murder suspect.

If what I've heard is true, then I think he's guilty. But I can't trust anything released by the DA's office, anything said in the media, or anything a Judge rules as reliable, so I'm not going to pass judgment until I see the evidence.

The testimony about a five year old eye witness testimony is useless. It's a cash purchase, on a man who looks substantially different now than he did 5 years ago, it's been freaking five years, and there's no surveillance video?? And she's not certain, she only "thinks" it's the same guy. If they're reaching with this, it makes me question what else "evidence" they actually have.

Link? I hadn't seen that. And if that's the case, why did it take 5 years to come to light? (I don't know this case well, so I'm not arguing, just saying I don't believe a thing the media reports anymore).

I think it's more that it took five years for this case to finally make it to trial, not that it took five years for this woman to come forward.

I just mean--why did it take 5 years for this information to hit? I got the impression that this was "new" to the case, as far as, a new piece of information given to the defense. Do you think they've known all along and it's just now hit the media because of the pre-trial motions? Or do you think they just got this bit of information, on the eve of the trial, kind of Cooper-case style?

I do think it's interesting all the restrictions Judge Stephens is imposing on the jury. You can tell he saw the frustration with the jurors in the Cooper case. He's not allowing any arguing during the day, all arguing will happen after 5. I am not sure how, as a practical matter, that will work, but it will be interesting to see. And he's put a hard time limit of 4 weeks on the trial--I am not sure that is entirely fair. But I do think they should strive to stay in their estimate. Jurors were told 4-6 weeks in the Cooper case originally (the prosecution's estimate for their case was originally 1.5 weeks) and then it was bumped to 6-8 week including jury selection, and that one went what, 10 weeks total? That's certainly not fair. But saying 4 weeks and not a day more doesn't seem entirely fair either.

And good move on the defense for making him cut his hair. The long haired look would not have done him favors with the jury.

this dude is guilty as sin, and he is nailed to the fucking wall.

this won't even be a close enough to have any semblance of a chance to go the way of the defense. young's toast.
