It's signed.
Seems legitimate to me.

Did they set a time frame in these "letters" for when the changes would be made? Maybe they were trying to find appropriate booths to suit his fat-fucking-ass? And did they just have to change one, or every single possible White Castle that this fat-fuck could drive to (which means all of them). In that case they had to find appropriate funds to replace all of their booths to accommodate him the rest of the fat slobs in America so they didn't have to continue to deal with this stupid shit.
Could he not sit somewhere else? I think a 290lb guy can sit in a chair. Did it really deprive him of food from Whitecastle? Can he not go through the drive-thru (it says he sent his wife)?
Being an attorney, I usually back-up these lawsuits. But methinks this one has no merit. Oh...and GeniuSxBoY is an idiot.
Quote : | "Is there or is there not, a magnitude of lying?" |
There is no law against "lying"...what are you, 6 years old?? This falls under whether he has a claim by using the Disabilities Act and/or whether or not he can say there was some sort of contract from the "letters." But just because something is in writing doesn't mean there is a contract. There has to be consideration for it to be an actual contract...and I'm not sure there is any of that in this case. But its a slightly gray area.

Lying under oath in a civil court is perjury. It is punishable by law.
Why should it be any different outside of court?

I'm pretty sure he doesn't have his lower back against the backrest in that pic. Unless he has like 4' femurs that result in his shins almost reaching the other side of the table on a normal basis. I, too, can scoot my but out until my stomach touches the table.

I'm just trying to appeal to you because you bitch about money and taxes so much. Obviously that didn't work...
I'll try and make it simple for you. Lying is immoral...not illegal. If we made every immoral thing an illegal act, then we'd all be in jail. Quit arguing for the sake of arguing. You're wrong...it happens a lot to you, so it's about time you deal with it.

This guy is wronging himself by eating too much and at least attempting to be slightly healthy.
It would be immoral for me to take this guy's money for legal fees. And I wouldn't waste my time to take this case on a contingency basis. 9/12/2011 10:10:32 PM

There was a guy in my Java class a few years ago who had this problem.
He was ~3ft, maybe 4ft wide.
He would come in every morning and squuuuuuuueeeeeeeeeeeeze himself into the booths/tables/whatever they are in EB2.
Then he would break out the soda and doritos for our 8am lecture. 9/12/2011 10:23:55 PM

Is the guy really wronging himself? Is being fat illegal? No, it's not. It's disgusting and he will die from it, but it's not MY life to worry about. It's his.
If you ask someone politely, in a serious, hand written letter requesting for a larger seat and they say "yes" and not accommodate to their word, this should be punishable. They should have just said "No." Preferably, but not necessarily, followed up by a reasonable and rational answer. Obviously the cost is negligible to white castle to install a larger seat, what other reason do they have for denying this man a larger seat?
Blatant lies like this should be punished and I believe that's what's going to happen at the end of this lawsuit

If you call a restaurant and ask for a reservation, they say they can accommodate you, and you show up and there isn't a seat available...do you think you can sue?
I'm going to stop arguing with you after this part, because it's obvious you don't know what you're talking about. In order to for a lawsuit to be successful...you have to show damages. What exactly are this mans damages? Can he still eat White Castle? Yes...his wife picks up his food. Can he still sit down and eat White Castle? Yes, he can sit down and eat that shit at home.
I'd love to see the lawsuit just to see exactly what he's claiming as damages.

No, I believe every instance of lie should be scrutinized independently on many factors.
1) Was the lie malicious? 2) Was the victim of the lie affected by the lie physically? 3) What was the motive for lying? 4) Was the lie more necessary than the truth? (Macro-example, a spy must lie about who he is, otherwise there is no point in him being a spy. Micro-example: Did you lie to your wife about her looking fat in that dress in order to preserve the peace and to promote your relationship)
There are more ways to scrutinize whether a lie was used wrongly in a conflict or justified. Every case is different. It's usually easy to tell which party is at fault.
In the case of white castle, white castle lied for no reason. Victim was affected. Moral of the story: Don't lie needlessly.

why should white castle be liable for not holding true to a contract that was never made or signed?
moreover, your request for prosecuting people who are injured by a lie basically already exists. If you can show actual harm by a lie, whether it be libel, slander, or anything else, you can recover damages. basically, your whole concern is moot, because it is already covered by current law. show you've been harmed, you get paid.
how the fuck was this guy harmed? is the dude gonna die now because he can't sit his fat ass down at his local White Castle and get fatter? is he losing income because he can't sit down at White Castle and swallow some sliders? Did the chair collapse and crush his cat on account of it not being properly balanced for his weight distribution? Did he fail a math test because he wasn't able to study as well while slurping down the big gulp at his local White Castle? what, kind sir, is his specific case of harm? butt hurt?
