If the person who invented the mouse (Xerox most likely) patented every movement gesture used (like double click) and then tried to charge a fee for every piece of software (even outside computers and the mouse) that uses the double click gesture; would people think that was ok?

Apple is not only exploiting the patent system, but they are defrauding FRAND and the benefits it gives to consumers. This will push other companies to go non-FRAND like Apple and make figures like this (10,000x FRAND Standard Rate).

oh last I checked Apple doesn't make a computer than can max out BF3 @ 1920x1200 and never drop below 40fps, but last I checked Apple and I aren't in a competition to build computers. Also I would not buy anything made by Apple if I was CEO of NVIDIA.

I understand how you can patent technology, as well as control systems. I'd argue that you cannot patent innate human qualities such as motions or gestures
It would appear that apple's argument is that the gestures are the control, thus subject to patents. I think that's a losing battle though, as the gestures themselves fall so clearly in the realm of  common knowledge.
