Sounds like to me that those kids were trespassing. It sucks what happened but there are usually consequences when you break the law.

If I hop a fence and go play at an airport and stumble onto the runway and a 747 lands on me, then that's my fault.

You'd be wrong in this case. Check out case law on children and attractive nuisances. These kids walked through an open gate. They were hardly jumping fences.

assuming this water treatment facility is operated or funded by local government, they will have very explicit safety documentation that probably references the fence and gate specifically

that will go a long way in court (or while negotiating a settlement)

This also had a drain, sucking at the same time, according to the article. I think swimming would have helped him. But if the force was too much for him to grab the stick he was offered, and pull himself out, I'm not sure swimming would have been enough to save him.

If three other *children* were able to jump in to try to save him and they did not drown as well, I doubt that the current was strong enough to overpower someone who knows how to swim. Also, it sounds like he was able to struggle against the pull of the water for a period of time, I bet knowing how to swim would have saved his life.

if a kid walked into my home unannounced right now, day or night. Getting killed by the tub is the last thing on the list that would constitute as being hazardous... ***as in my house is a death trap if you can't navigate through the junk, successfully avoid the vast amount of vast of dangerous pointed and sharp objects hanging on the walls. *** (And me possibly being armed with a sword and a shotgun... actually shotgun with a sword on the bottom).

Unfortunately, our society has degraded to the point to where a lawsuit is likely and is likely to be won in this case. It's a sad story, but these kids were trespassing and knew they shouldn't have been there. It's no ones fault but the kids.
