Correct me if I'm wrong here, but I believe that the case has already been settled and settlement funds have been allocated. Therefore the money is already there to be claimed. So you aren't actually taking it out of their pockets.

Whoever is talking about getting free nutella and feeling guilty for it has flawed logic. If you think about it, you most likely saw one of the erroneous nutella commercials and believed them that it was healthy. Therefore, based on the ruling, you are entitled to some compensation for their unethical and misleading advertising tactics.

Their advertising clearly alluded that this was a healthy addition to breakfast when it was a mound of sugar with a handful of hazelnuts and a pinch of cocoa. That's not how class action works. It cost Nutella $3M regardless of the number of folks who signed up for the suit. If anything they were stealing from real people who actually deserved to get a cut of the settlement.

But I don't think you get the point of these type of suits. It's not about getting free money or "stealing" from corporations. It's about holding them accountable for their actions. They profited handsomely thanks to their misleading advertising. Stripping them of their ill gotten gains is one of the few means the legal system has to influence them to act in accordance with the law in their future advertisements. And $3M is still chump change for these guys. This is the $6 parking ticket of lawsuits.

BTW, fuck Nutella. Go to Italy and you can get some actually healthy gianduja (chocolate hazelnut) spreads. They are made with about 40-45% hazelnuts (Nutella is 13% lololol), either no added fat, or the added fat is healthy, such as olive oil or cocoa butter. They are relatively quite high in protein and fiber (2-3x that of Nutella), and have half the sugar (or less if you opt for the dark chocolate versions!) of Nutella.

Yes, I see. You're not stealing from Nutella Corp; the sum of money they're going to lose is fixed. But the actual purpose of a class action lawsuit suit isn't really relevant to my point. I still maintain that since the terms of the form say "Class Members can receive up to $4 per jar of Nutella that they purchased during the time periods listed above," if you didn't purchase any nutella it's dishonest, and stealing from ppl who did, to register as a claimant. /annoyngselfrighteousass
