Reminder that Stand Your Ground only works if you're not a Black person

http://www.youtube.com/watch?v=4xGgAVtn42k

Quote :
"It took nearly a year’s worth of violent physical abuse before Marissa Alexander decided to stand her ground against her husband.

On Aug. 1, 2010, her husband cornered her in their Jacksonville, Fla., home. Alexander said she ran to the garage to escape, but the garage door was jammed, so Alexander grabbed a pistol. Her husband, Rico Gray, 36, saw the gun and threatened to kill her, Alexander would later say in court documents.

Fearing for her life, she raised the pistol above her head and squeezed the trigger, the crackle of gunfire pelting the kitchen ceiling.

While the shooting may have gotten Alexander out of one jam, it put her in another: She has been in a Florida jail since 2010 awaiting a mandatory sentence of 20 years in prison for aggravated assault with a deadly weapon."

If the shot was fired in the kitchen, it goes to prove that she was where she was supposed to be and that her husband was the one in the wrong.

Case dismissed.

The way I've understood such laws to work, if you're firing a warning shot, then you "don't have the fear of imminent danger or death". The law is such that you use deadly force as a last resort and you use it to stop the threat. Not to scare it, not to hurt it, but to end it. I don't know if that's the basic reasoning behind this case, but this simple explanation has been passed around before. Of course, some of you lefties have problems with this because you say it's shoot to kill, which it is, and isn't. You're shooting to stop the immediate threat. Injury or death are side effects of that. Of course, do you want people randomly firing warning shots or trying to cap a knee? That's how bystanders get hurt.

Let me see if I have things figured out here:

-Firing a warning shot inside your own house at a man who beat you for a year when he threatened you? 20 years in prison.

-Firing a shot outdoors in the middle of a neighborhood into the chest of a 17 year old you chased down? Innocent.

- If she suffered such violent physical abuse she should have been far away with a restraining order to fall back on if he tries to come into contact her.
- Sounds like really good gun control to live in a house with children where it's easier to find a gun than an exit.
- Firing a warning shot inside a house is not a safe alternative to firing at an actual target. Bullets can go through ceilings and into the rooms above in a two story home. They could have ricocheted and injured herself or her children.

Yeah, I guess it's much easier to hit a moving person than a ceiling.

Look man...The law is generally pretty clear on when and where you can fire. If your life is in danger and you didn't instigate the conflict then go for it. You're still responsible for your bullets, so plan to be charged if one of your wild bullets injures or kills an innocent person. Zimmerman obviously didn't hit anyone or anything except his intended target so you might as well drop the argument about firing shots indoors versus in the middle of a neighborhood.

Warning shots are a big "no-no" just about anywhere. If you're going to have guns in your home and you're going to rely on them to defend yourself you should take the time to learn the laws regarding their usage. She obviously didn't do this and that's why she is in jail today.

Do I sympathize with her? ABSOLUTELY.
Do I think she's a bad person? NOT AT ALL.
Did she make a big mistake that could have had very bad consequences...Yes sir.

Ahh, so as long as you kill the person you were trying to kill, there's no chance you were endangering other people in the neighborhood?

I'll remember that.

"But moments after the shooting, Gray ran outside and called police alleging that Alexander shot at him and his two sons. Alexander was arrested and charged with three counts of aggravated assault with a deadly weapon.

Gray later changed his story about the shooting. During a court hearing to determine whether or not Alexander could be protected under the Stand Your Ground Law, Gray said he'd lied during his earlier deposition and that he "begged and pleaded for my life when she had the gun.""

God, have you no sympathy for a black man begging for his life? Wow, you are the worst.

The law says that you can fire a weapon to save your own life. If you are negligent in the discharge and hit an innocent person you can expect to be charged with manslaughter. Pretty good motivation not to fire a weapon unless you really are saving a life, eh?

You can also swerve your car to avoid a dog without being charged with reckless driving, but as soon as you take out a row of parked cars you'll probably be at fault.

Plz remember that.
