"Officer Travis Abbott came and just arrested and made a huge scene with our house administrators," a nurse told the 911 dispatch supervisor in the call. "He just handcuffed her – he could care less about anything – in front of the middle of our ER. And this whole ER is in complete chaos, and frankly, somebody needs to come here and handle it."
The nursing supervisor was released from Abbott's handcuffs after Smithfield police and Johnston County sheriff's deputies arrived.
Selma police are investigating the claim but won't comment on the specific allegations.
They did confirm that the DWI suspect was later taken to the county magistrate, who released him because there was no probable cause.
Abbott has been with the Selma Police Department since 2009." |

Nurse was 100% in the right. Unless the subject is unconscious with clear evidence of DUI, blood samples require the consent of the subject or a court order. Refusing consent has consequences, of course. Had she performed the procedure she would be guilty of assault and battery. 11/14/2012 3:27:58 PM

The "suspect" probably legally refused field testing, so the cop decided he would break the law and force a blood test with no probable cause.
I would like to point out that the cop is the only one that broke the law in this instance, and also the only one involved that has not been placed in handcuffs. The nurse and the "suspect" have both been treated like criminals, but the only one that clearly broke the law was the cop. 11/14/2012 4:51:34 PM

Or not. I know a guy who got t-boned by a speeding cop who was flying through a 35 mph zone around a blind corner at 55 mph with no lights or sirens. Flipped the guys car and when he ended up in the hospital the cops were trying to make the nurses give him a blood test for alcohol (he hadn't been drinking). The nurse flipped her shit and told the cop off. In other words maybe this is just another corrupt cop trying to act like he has the biggest dick in the west. Guy should be fired immediately but I bet he will just get suspended with pay for a couple months until this all blows over. 11/14/2012 7:38:00 PM

Forced blood draws have been increasingly thrown out as evidence all over the country. The Supreme Court just agreed to rule definitively on the issue in coming months. Once again police will find themselves on the wrong side of history.

In many places they let the cops do the blood draw on the hood of their Crown Vic.
Here are some comments of our nation's finest on a law enforcement forum:

Back in the 'old days' we kept a VERY LARGE vets syringe and needle in a drawer near the Breathalyzer.When clients asked about a very time consuming blood test (at hospital)we would pull out the syringe. Most clients changed their minds!!!
We offer ours the services of, "..a Doctor, being a fully qualified Medical Practitioner, of your choice, to take a sample of your blood for analysis." They generally get spooked when we go on to say that the doc is to be paid for by them and we also get a sample. I have had a few smart-ar$e$ pull the 'blood sample" routine on me. In 18 years I have yet to come across a doc who will drag himself down to the cop shop at 3am on a Sunday morning to draw blood from a drunk!! As for cops drawing blood.....well not under those circumstances!! 
There's usually someone in training who needs the practice.
I take mine to the hospital, right in right out. The best part of it is seeing the good looking nurses that are working the night shift.
BTW I NEVER Mirandize my DUI arrests.
I don't mirandize either. You're right, it's better to let them talk their way into a conviction. 
If it comes to a warrant draw, and the Dr. refuses we can and usually warn him and if he continues to refuse - arrest him for failure to follow a court order.  " |

A lawyer friend of mine has told me that you do not have to take the "field sobriety test either". He said that walking the line and touching your nose and all that stuff only allows them to further build a case against you. 11/15/2012 8:04:01 AM

The only test you will be penalized for not taking is the breathalyzer at the station. (this would be post arrest most likely) If you refuse that test you automatically forfeit your license for 12 months, even if you are never charged or convicted, its a DMV regulation, not a criminal offense.
The handheld BAC tests you can supposedly refuse, you can refuse to do field tests like walking the line or the eye following thing, you can even refuse to talk anymore after identifying yourself and handing your license over. 11/15/2012 10:52:32 AM
