My bf's divorce attorney (who he has developed a repoire with, has been invited to his house for drinks after a hearing, have talked about playing golf with and whatnot) recently had his first baby. I think my bf should send him a baby gift, or at the very least, a bottle of nice wine (he is a winemaker) in congratulations.

Is this inappropriate while they still have a client/attorney relationship? I think it's just a nice thing to do in general, and especially because he has continued working through his "paternity leave".

check the state bar's ethics decisions. you can usually do a search for "gifts" and find it fairly quickly.

He should send him a case of wine. It's his attorney, he can do whatever he wants. As long as he's been paying his fees, I can't see how this would be an issue.

The general rule is that attorneys cannot solicit substantial gifts, and they mainly worry about lawyers being written into wills or getting testamentary gifts. I'm assuming this is NC, but if not, most states follow the ABA standard ethics rules. If this is your own idea and it's just a bottle of wine, you're fine.
