Now, Foster says her goal is to stop a search warrant to obtain more photos of the boy. "I don't want him to go through that. Taking him down to the hospital so he can get an erection in front of all those cops, that's traumatizing," she told the Post. If the boy is found guilty, he could be forced to register as a sex offender and serve jail time until he's 21. The boy's guardian at litem in the case, Carlos Flores Laboy, thinks taking the photos is illegal. "They're using a statute that was designed to protect children from being exploited in a sexual manner to take a picture of this young man in a sexually explicit manner. The irony is incredible.""

Oh, it's nothing. We JUST take this minor against his will and use force to remove his clothing, use force to inject said minor with a drug to cause an erection and then take photographs of said erection, but it ain't producing child porn when we do it!!!

^^ That's about the only way this comes anywhere close to making sense. The child porn is 'just' over-charging; an harassment charge of some sort would seem more appropriate. Forced erections and penis comparison software (!?!) is just ridiculous. Maybe he's denying it's his junk...?

Actually whether it's wrong isn't the issue (that fact is well established), instead they want to do it in order to show that the unsolicited pictures sent to the other minor were his, without broadcasting the pix to a wider audience (then again this bumps up against the notion of a "speedy and public trial"); in a way it's similar to how part of the FBI keeps a stash of known child-abuse images around to compare against suspected child-abuse images, except the FBI doesn't produce more images of suspected victims.
