I wish NC had more relaxed policies regarding alcohol. Re: Sunday alcohol purchase, open container laws, etc.

Honestly, the whole concept has more or less fallen by the wayside for me, since I moved back to DC. It is just not an issue. This is due to public transportation... It is easier to take the subway, walk, bus, or get a cheap cab than drive 9.5/10 times. 8/5/2014 9:29:37 PM

i've never heard of a drink referred to as a "roadie"
i mean, i assume it's an alcoholic beverage that you drink while driving or riding as a passenger, but this is the first time i've heard that term.
but anyway, i don't approve. reward isn't worth the risk. not even close.

"Road beers" is usually my term for this. And if we're going to a football game or something like that, I'm fine with people drinking in my car, if I'm the one driving. I would never drink while I'm driving though. But if my passengers want to drink a beer on the 20 minute ride to the stadium, then that's fine with me. 8/6/2014 8:45:50 AM

No drinking as the driver, but I will let people drink if I'm driving so long as they aren't already drunk or being obnoxious. Before I turned 21 I wouldn't though, and I remember pissing a few people off by telling them they couldn't bring an open beer in my car.
I once drank a FourLoko while Fareako was driving on a trip to Georgia. Pretty sure he thought about stopping at a rest stop and leaving me there because I was in drunk hyper can't stop talking mode. 8/6/2014 8:53:47 AM

G.S. § 18B-401 says that it is illegal to transport open containers in your car , but G.S. 20-138.7 requires that you have alcohol in your system. So my understanding is that only the passenger would be guilty of violating G.S. § 20-138.7, but the driver would still be guilty of violating G.S. § 18B-401 even if they have not had any alcohol.

I was okay with taking the risk as a passenger (never the driver) until several years ago when I was on the way back from Carolina Beach after a rained out beach party. We stopped at a gas station, and I asked my buddy who was driving if I could take a road beer. He said he'd prefer if I just chugged it in the parking lot, so I did, and less than a mile down the road there was a check point

The open container law was to prevent the driver from being able to hand a beer off to passengers. I am almost certain the driver can get the ticket and is responsible for all in the car. 8/6/2014 12:15:14 PM

fun fact - if you ride in the trunk of an SUV or the bed of a pickup truck in NC it's not considered to be a "passenger area" of the vehicle and you can drink all you want.
