The video is horrific to watch, even though there is no shooting or blood. Just the barbaric actions of the cop... I mean, is he even a human, let alone a cop? He is completely acting like a sadistic gang member, not like a civilized human.

And after doing that he deleted the video on the cellphone in the car, but the 18 year old girl (driver) found it in the "Recently Deleted" folder. (Boy was in back seat)

Sure, you should follow reasonable requests by a cop. But I think being hesitant to get out of a car because you are a scared-shitless-teenager shouldn't be grounds for a cop to beat the shit out of you and taser you. I'd like to think that a cop has the proper training and knowledge to figure out the right way to proceed in a case like this. Instead, it seems that his training instructed him to delete evidence and go in, tasers and pepper spray a-blazin!

meh, I'm just about okay with what this teen got. he didn't seem scared shitless - he was talking back to the cop, for lack of a better phrase - and I didn't see that he got the shit beaten out of him either.

I don't much approve of the cop trying to delete the video from the phone, but I can't blame him too much.

this kid ignored an order from a cop, and he got roughed up a bit. I always figured that's what happens when you ignore cops' orders. it's not like he's suffered permanent damage or anything.

^^no, his training does not say that. That's why he will prolly be fired and sued. I hate when people lump all cops in when dumb cops do stupid shit that is not trained to them.

I do not agree with what this cop did at all. Obviously, he no longer should wear a badge and deserves whatever civil judgement and criminal judgement comes against him. If you can't handle an adult or some kid mouthing off to you without resorting to violence, get yourself out of the profession Asap because I'm tired of it getting myself and other colleagues in law enforcement a bad name.

I will say though, if you get pulled over, there's nothing that will get you in the good graces of a cop like showing them respect. Yes sir/ma'am, no sir/maam...no sarcasm/assholishness. If you show respect, most of the time you will get it. If you come with sarcasm/being an asshole...the cop is going to be suspicious and you run a higher risk of running into one of these asshole cops that can't control themself. I'm just trying to help people get through their encounter with an officer safely...not making an excuse for these shitty cops. Show respect and don't be an asshole should be two easy steps. Sadly, for lots of folks...it's not.

But as far as this situation, as I said, this dude was wrong and should be let go

I do find it weird that he wouldn't exit. He said he would exit with his mother there because he is underage and didn't want to be touched by a cop... I have never heard that line of thinking of before, but if he requested that, would it have taken too much out of the cop to wait for a bit till his mother arrived?

that makes no sense. there is no legal reason why the cop should have waited for mommy. the cop had no reason to believe that the kid was telling the truth, and more reason to be suspicious since he directly disobeyed a reasonable and common command from the cop.

Well...if the cop had suspicion that there was something illegal like drugs or some such contraband...he would want him out of the car asap so that there would be no way for him to tamper/destroy it. the kid was prolly a butthole, and I don't know anything about the situation...but there are other ways to handle the situation.

^^ ok so if he was refusing to get out till his mother got there but the cop wanted him out immediately, how else could he have handled it other than brutalizing the kid?

I am trying to think but drawing a blank. obviously, i severely condemn what the cop did, but i am trying to think of other ways he could have handled it and had him out of the car without waiting for mommy.

Plus, it's ridiculous pussified 21-st century bullshit to say "Don't touch me, my mom's not here." It's not even remotely close to a reasonable request, coming from a 17-year-old.

My goodness, the kids we're raising these days. if we have to fight a war any time soon, we're going to be in trouble.

If the cop actually felt like he handled the situation properly, I'm not sure why he would try to delete the video of what went down. That is what makes me more upset. The cop made a decision to rough the kid up. If he actually thought that was the right call, the video should only help his case. But rather than stand-by his decision like a man, he tried to cover up evidence of how shit went down.

The cop is the real pussy in this video.

the driver was the one that was arrested for possession, and her driving is probably what led to her getting pulled over.

Something short of beating the shit out of a kid who is scared shitless, maybe. One of the people involved in this situation was an adult. I kind of expect that person to act like it.

I want you to actually tell me what he could have done. I want you to solve this puzzle:

# Kid is refusing to come out till his mom gets there
# Cop wants him out now and not wait for mom
# Cop can't use the types of force he did use (mace, taser, and beating)
# How does cop get him out without force and without waiting for mom?

This is a thought experiment, come up with a solution.

I made this thread, so obviously I am not condoning in any way what the cop did. I am just saying it was an impasse, and the cop thought the only way to get him out is to assault him.

This is my solution, but I don't know if it is viable because if it was feasible, the cop would have done it: Open the door and drag him out without ever hitting him or using weapons. So, why did he not do that? I mean, the window was open, right? Why didn't he just open the door and drag him out? What stopped him from doing that? This is baffling.

what harm would it do to wait for the mom? Considering the charged atmosphere and increased publicity on police brutality/actions, did the cop think about ramifications of his own actions? Did he escalate or diffuse the situation? If the cop was right in his actions, why did he try to delete the video? If he did nothing wrong why is he trying to destroy video evidence?

I mean, its not like the kid had just killed people or even did a crime worthy of anything beyond a traffic ticket.

I thought the cop handled this situation fine. The kid doesn't want to be touched? Fine, get out of the car like they asked you to and go stand on the side of the road while they search the car. Stalling for his mom to show up when he hasn't even called her yet and bitching about how he's not moving and not going to follow instructions was just plain stupid. Still refusing to comply when they try to drag you out, again when they point a can of pepper spray at you, refusing again after being sprayed with pepper spray, refusing when they're pointing a taser at you, and refusing after they hit you with the taser is just idiotic. I guess weed is known to delay response times and can influence people to make really stupid decisions.

I think it was another officer that turned off the cell phone, not the officer who used the tazer. It seemed like there was another officer on the other side of the car pushing the kid out that then turned off the video.

FYI. I was curious whether the police can demand a passenger of a car get out during a routine traffic stop. So I did some googling and the answer seems to be that they can.

That still doesn't mean the cops didn't cross a line in how they handled the situation (again deleting that video to cover up their actions blows my mind). But it doesn't sound like the kid had the right to wait in the car.

Cops can pretty much detain anybody for anything, at least temporarily. Cop could've probably grabbed him out of the car instead of spraying and tasing, but I'd be more pissed at this particular cop if the kid didn't seem so spoiled.

Felony prosecutions occur all the time based off witness testimony, go ahead and charge him and let it get sorted out in court, if he is not guilty he will have his day to prove it.

Let's break this shit down. First, let us assume that everything the officer is investigating is true as we have no evidence to the contrary.

The plain smell of marijuana is two fold here. First, it's enough to detain you*. The officer has the right confirm or dispel his suspicion that illegal activity is afoot. Second, it allows for a probable cause search of the vehicle.

*Pennsylvania v. Mimms (Driver) & Maryland v. Wilson (Passengers) can be ordered out of the car with reasonable suspicion.

Next, the back seat passenger was given a lawful order to exit the vehicle. In the Commonwealth of Virginia (North Carolina as well), the courts do not differentiate between minors and adults when it comes to search and seizure. In fact, I'm not sure any state does.

He resisted a lawful order to exit, albiet passively by running his gums. While he does say that he is going to get out, when the officer places hands on him*, the teen pulls away. Now we have gone from being a passive resistor to an active resistor.

*In an investigative detention, your movement is restricted an officer can use a reasonable amount of force to detain on control your detainment.

With an active resistor, a chemical agent is an appropriate use of force.

After being exposed, he still continues to use his right hand to swat at the officer(s) trying to extract him from the vehicle.

The chemical agent is no longer effective, so a TASER was used. While the TASER isn't the incorrect choice here, some good old fashioned pressure points could have been an alternative. It did not appear that a good TASER connection was made because he was still able to squirm about.

What is the problem?

***Yes, there are allegations of evidence tampering, but I'm talking about the use of force.
