If this is as clear cut as the article makes it, Castle Doctrine should be complete valid Id think. Will be very interesting to see how this plays out given a valid "threat" and trespass.

I don't think this guy deserves 2 felonies.

Kentucky Law:
512.020 Criminal mischief in the first degree.
(1)
A person is guilty of criminal mischief in the first degree when, having no right to
do so or any reasonable ground to believe that he has such right, he intentionally or
wantonly defaces, destroys or damages any property causing pecuniary loss of

(2)

508.060 Wanton endangerment in the first degree.

He may have been charged but I figure this'll get thrown out in court.

Be interesting to see the precedents that take place if this thing gained any traction.

Chalk me up as slightly surprised that this man from Kentucky did what he did without coming off as some sort of lunatic. I know I'm not the only one based on the name of the article.

i read somewhere that shooting a drone is legally the same as shooting any aircraft... because the FAA controls the air, even if it's half a foot over your property.

This guy shouldn't get in trouble, but it also shouldn't be legal for people to be able to shoot at things they see flying in the sky. Too much can go wrong if we allow that carte blanche.

The law should be strict against it, but judges/jurors should have broad leeway to consider the circumstances.

Also, law enforcement needs to adapt by acquiring tools that are capable of dealing with illegal use of quad copters.

if you have no right to shoot down a drone hovering over your property, then go take a drone and hover over government or military property

^ There's a CIA pilot training facility in eastern North Carolina. It's not marked on any air maps that a strip is there. My dad sometimes flies over it for fun because "it's not there".

Really it goes back to how laws haven't caught up with how to deal with drones. Seems like there should be some kind of Congress-led law that drones aren't allowed to be inside property markings beneath a certain height unless "invited".

I have trouble believing a drone was shot down from 90 yards away with birdshot. Maybe the drone was a lot closer than being claimed in that video, or the shooter was using something like #4 shot instead. Hopefully not the latter, because I could see #4 shot potentially hurting someone falling back to earth.

#4 shot isn't going to hurt anyone falling to earth. It's just not heavy enough.

I think #4 shot could potentially put an eye out falling back down, something I wouldn't expect birdshot to do.

It wouldn't take much to down a drown like this, if it's a quad, just 1 propeller getting gummed up would cause it to crash.

hitting it isn't in question; hitting the drone with any energy left in the shot is another story. The shot can travel about 200-300 yards, but the effective range for breaking clays is probably closer to 50 yards.

Clays probably break easier than the plastic used in making drones.

It could be possible that the drone wasn't broke by the shot but was rotated off its axis enough that it couldn't regain control. I'm not sure if they are capable of inverted flight.

im sure there will be legitimate protections of privacy, but people are also going to shoot drones that are just passing by and not even directly above their property

and of course:
