i'm in nash county and need a nash county attorney.

no other tickets, other than when i was 16 (26 now) and got a speeding ticket reduced to improper equipment or something.

we've (my family) used joe hester before and i want to remember that he was kinda expensive. he was next on my list to contact though. we (my workplace, dad's architectural firm) designed his office back in 2000ish so maybe he'll give a deal.

also, is it okay to go back to an attorney with a higher offer and be like "look this other dude said $300 instead of $330, can you do better?"

just got a call back from the 3rd attorney. he said $275. i tried to call joe hester twice but it's busy...kinda weird. i'll try again in 30 mins or so.

i have a feeling unless he just really likes my dad, $275 is gonna be the winner

One more plug for Mr. Crouch's office. Got my Reckless Driving dropped entirely and my concurrent 74 in a 45 reduced to 9 over. Mr. Crouch is THE MAN.

I normally do them for $75 + court costs for friends of friends. (good friends, I do 'em for free)

As many of you folks are getting tickets, perhaps I should start taking some on from people here at the same rate, lol.

Ok I just got a ticket yesterday for doing 81 in a 65 on 40 in Wake County.

This is my 2nd ticket. My first one was in Wilkes County and it got dropped and it was also over 3 years ago.

First, how much is the ticket and court costs going to cost. It has NO mention of it anywhere on the ticket.

Second, will a lawyer actually be able to get this dropped for me, or will he just get it reduced?

If your first ticket was truly dropped, then you were never convicted, although they know you were charged with it for a reason i.e. you have a slight history of speeding so they won't think this one was completely accidental. Wake Co court costs were $110 a few years ago, I can't remember exactly now; plus the fine which is maybe $75-100. I'd say it would be easy for a lawyer to drop it to 9 over, although dropping it completely isn't out of the question.

My wife just got her results last week, she got improper equipment, it was in Guilford county though. 80 in 65, she just called up all the lawyers that mailed her crap and went with the cheapest one ($50 + court cost and fine) ended up running her $200 total.

Wake Co will not let you have an improper equipment charge for that very reason, only certain counties within the state have it available. I asked my lawyer that, too.

court costs are $121 and you only pay the fine if you are paying the ticket off and admitting guilt and taking the points.

i love that people think lawyers can reduce everything, it all depends on the judges and the d.a.'s and if they are in a bad mood and you get a cheap lawyer you are screwed. its always worth it to pay the bucks for a good attorney so they can continue it a few times for you

In the 16 months since legislators tried to close loopholes that let the fastest speeders avoid harsh penalties, some judges and prosecutors have ignored the new laws or found ways around them.

Nearly 12 percent of those charged with driving more than 25 mph over the speed limit got breaks that legislators tried to outlaw, according to records from the Administrative Office of the Courts. Prosecutors since December 2007 have been forbidden from allowing those speeders to blame their indiscretion on broken speedometers; also, they forbid judges from granting "prayers for judgment continued," a forgiveness of sorts, in these cases.

Across the state, the rate at which these high-speed drivers were found guilty as charged hasn't improved. In most districts, there was a surge in another type of deal: reducing the charge to 10 mph or less over the limit. That break spares insurance rate increases and points on a driver's record.

Sen. Tony Rand, a Fayetteville Democrat who helped shepherd the legislation in 2007, was flabbergasted.

"What do they want me to do? Pass another bill this session saying I really meant the one we passed in 2007?" Rand said after being presented with the findings of a News & Observer analysis.

"Unbelievable."

The legislature's action in 2007 followed an N&O series that found speeders are rarely punished in North Carolina. Overall, only about 17 percent of speeders are found guilty as charged; that rate didn't change after the law did. Conviction rates are even lower for the fastest drivers.

North Carolina courts have long been overwhelmed by the volume of speeding tickets. Since December 2007, law enforcement officers ticketed more than 779,562 speeders. In some district courts, hundreds of drivers report each morning seeking painless resolution to their ticket. Prosecutors and judges oblige, saying they don't have the resources to try even a handful of speeding cases a day.

All the while, North Carolinians continue to die in speed-related crashes. Across the state, an average of more than eight people died each week in speed-related crashes, according to the UNC Highway Safety School. That's a slight reduction from 2006.

A Highway Patrol spokesman said he is disappointed. "The Highway Patrol will continue to work hard to make a difference on our highways," said Capt. Everett Clendenin. "We hope the courts will join us in our effort."

In almost all districts, judges and lawyers granted concessions since 2007 that the legislature had banned. Some have done it more regularly than others. In Johnston County, which has seen a rash of speed-related crashes involving teenagers, 94 drivers caught speeding more than 25 mph over the limit were found guilty of having a broken speedometer -- a break legislators say they outlawed in 2007.

In Wake County, judges granted 362 prayers for judgment continued, a resolution that, in effect, wards off insurance and driving record penalties.

In the Triangle:

In Johnston County, a trooper clocked Alexander Michael Green, then 16, driving 80 mph in a 55 mph zone on a rural highway in January 2008. Three months later, a prosecutor granted a request from his attorney to plead guilty to having a broken speedometer. In August of 2008, the Smithfield teenager was ticketed for traveling 75 mph in a 55 mph zone. Again, he pleaded guilty to improper equipment.

In Wake County, a Raleigh police officer stopped Susan Lynn Deyton speeding through a school zone at 52 mph as school let out. In court, the prosecutor dismissed the speeding charge and changed it to reckless driving, enabling Wake District Court Judge Shelley Desvouges to grant a prayer for judgment."

not really asking advice because i doubt anyone lives in Washington, LA but I got pulled over for doing 8 over. i just wanted to note how much this economy sucks when someone with a perfect driving record like me gets a ticket because these small towns need money and start pulling people for 8 over. too bad its all going to go to a lawyer and NOT your city.

fuck got in trouble again in the boonies
80 in a 55 down a windy mountainside in a speed trap

i'm freaking out now - what should i do?

1st ticket in nov/dec 05 - dropped to 9 over, pled guilty
2nd ticket 44 in a 35 in may 06 - dropped by james crouch somehow
3rd ticket just this weekend 80 in a 55 - mandatory court appearance in wilson county

anyone know any lawyers there or if they do this special driving course or if they'll hear improper equipment arguments, or anything? i don't want to go back there just to go to court - it's right in the middle of exams too

the first one should be off your record by now. Its 3 years old.

Im not sure what you mean by mandatory court apperance. Normally I have a lawyer show up for me. If you cant, tell the university you have to be in court that day, gets you out of your exams.

dfshadow. Dont sweat it. A lawyer will take care of it for you. I got a 81 in a 55 a few years back. Took a few continuances, and an agreement to take traffic school, but it was reduced to 9 over.

Okay I just got a ticket about 5 minutes ago in front of my house. 57 in a 35. I have two other speeding tickets that were 9, from more than 3 years ago. The officer made no mention of them and recommended I take a safe driving class before the court date.

What are my options?

yeah their fees are $250 then the cost of looking up my record, the court costs, and the fee for 9 over all add up to that $420 price

cost of looking up your record- 8$
court costs - 121$
fee for 9 over? - think they made that one up, its normally reduced to 9 over and you pay court costs of 121 and sometimes a 9$ - 10$ fine

we would have charged you $330 attorney fee court costs and pulling your record

they take off some money if you pay with a credit card apparently and so that's how it all added up to somewhere around the $420 figure

I continued my 68 in a 55 - craven county. should i just get the DA to reduce it to 9 over, use a PJC, or hire a lawyer ? (originally i had just planned on taking the 3 years and asking the DA to reduce it myself, if he declined i was going to continue again and hire a lawyer)

^ I have similar question. Got caught doing 79 in a 55, 24 over. Its my first ticket. Can I save money on lawyer by just showing up to court and asking for PJC? I talked to a lawyer and he said he would use my PJC and charge me like $250. If all he is going to do is burn my PJC, can't I just do that myself?

i'm pretty sure i haven't seen this posted in here yet, but for everyone who asks about attorneys outside of wake county, or even for people who would like a list of attorneys and want advice from someone other than people on tww, try calling the nc bar referral number, 1-800-662-7660. you just have to tell them the county the incident occurred in and the type of case and they can usually give you a list of a few attorneys to choose from.

another site that may really help some people on here is the NC dept. of insurance website, especially their consumer section http://www.ncdoi.com/Consumer/consumer_auto.asp

Yes, you can ask for a PJC. If for whatever reason you don't get it, you can request a continuance to hire an attorney. Really it's more of a question of whether it is worth the attorney fee to avoid going to court.

If you can plea 9 over, and this is your first moving violation in 3 years, do that. It won't affect your insurance points and you can save the PJC. If you can get an attorney that can get the ticket reduced to a nonmoving violation (i.e. improper equipment) it is well worth the money IMO. It is possible to do this without an attorney with a speedometer calibration (a few mechanics will do that), but it is far less dependable and straightforward for a variety of reasons.
