First off, Zimmerman is obviously a piece of shit.
That said it is a baseless, kneejerk reaction that the police don't care / are covering up the incident because the victim is black.
The facts of the case make it very hard to prove beyond a reasonable doubt that Zimmerman wasn't acting in self-defense. Even though he chased after Martin, no one knows how it escalated from Zimmerman confronting him to the point where an eyewitness saw Zimmerman on his back, screaming for help as Martin was kicking his ass. The screams are on tape, and as I asserted on page 9, they were made by Zimmerman, not Martin. Since the police cannot prove that Zimmerman assaulted Martin first, then they can't disprove his claim of self-defense. 3/20/2012 5:17:51 PM |

The burden of proof lies on the person who is claiming self defense. Not the other way around.
You can't just go around with a gun and pick a fight with children, and then fucking shoot them if they fight back... ... well, maybe in Florida, you can.

Don't be pedantic. You know damn well that the burden of proof is on the prosecution, and that they must disprove Zimmerman's self-defense claims beyond a reasonable doubt. Zimmerman doesn't even have to prove anything, just that it was possible he wa acting in self-defense.
Or did you think that "innocent until proven guilty" only applied to liberals?

I think that burden technically shifts if the defendant is trying to offer a defense to explain their actions (affirmative defense). For example, if your defense is to say "I did such and such for reasons of insanity", it's up to the defendant to prove that he's insane. Likewise, if the defendant is claiming self defense, the burden of proof also lies with them.

Insanity is a different issue.
Zimmerman simply has to assert that it's possible that he was acting in self defense. Did OJ prove that he didn't brutally murder his ex-wife? Did he prove that ridiculous hypothesis about Colombian drug dealers?
Again, the burden rests on the prosecution to prove beyond a reasonable doubt that Zimmerman murdered Martin.

^^^Actually I kicked ass in civics, and I know that Self-defense is an affirmative defense. The burden of proof is on the defendant (usually) when the defendant asserts an affirmative defense.

As in, ...BUT I was acting in self defense or ... BUT I am insane
The burden of proving that the mitigating circumstance is valid lies with the defense.
