Nah, they're not lying. He didn't know they were using his likeness. He knew they were using pictures of him, but he didn't know what the word "likeness" means. There's your Tar loopHole.

They declared him ineligible and are seeking reinstatement

ahahahahahahahahahaha

Quote :
"Chapel Hill, N.C. - University of North Carolina senior wide receiver Dwight Jones committed a secondary NCAA violation when he allowed his name and photo to be used to promote an event in his hometown of Burlington, N.C.

NCAA rules prevent student-athletes from using their name, photo or likeness to promote a for-profit entity. UNC learned of the secondary violation and has declared Jones ineligible. Carolina has applied to the NCAA for his reinstatement.
“I apologize to my teammates, the coaching staff, and the University for the poor decision I made to allow my likeness to be used in the promotion of a party given by a family member while still a part of the Carolina football team,” said Jones. “I should have asked the coaching staff or administration before allowing this to happen. I was wrong and the party is cancelled. I’m sorry for being a distraction to our team and taking the focus away from our preparation for the Independence Bowl.”

“Coach Withers and I met, and Dwight realizes he made a mistake,” said UNC athletics director Bubba Cunningham. “Dwight has cancelled the party and we have submitted a reinstatement request with the NCAA.”

UNC’s compliance office also has sent a cease-and-desist letter to the party promoters.

North Carolina plays Missouri in the AdvoCare V100 Independence Bowl on Monday, Dec. 26. The team departs for Shreveport on Thursday, Dec. 22."

OSU gets a bowl ban, schollies pulled, etc. UNC is uber-fucked.

http://espn.go.com/college-football/story/_/id/7372757/ohio-state-buckeyes-football-penalties-include-bowl-ban

one year post-season ban
9 scholarships lost over 3 years
3 years probation
Show-cause for Tressel

at this point it would look better if UNC would just leave him ineligible instead of seeking reinstatement. "hey ncaa we've screwed up again and ruled this guy ineligible. since our track record with you all is so clean... do you mind reinstating him?"

Kinda wish they had issued probation so this would have fallen in that time frame.
Hopefully the NCAA sees this as a continuation of a cheating culture.

"And so, five days after his college career ends at that bowl in Shreveport, La., Jones is holding a party at 778 Sports Lounge in Burlington (view the full flyer, which is currently the profile image on Dwight Jones's Facebook page and which features a free-floating cigar and hundred-dollar bills raining onto a throne of gold). The promotion offers $500 to "some lucky ladies," not to mention 24 comped admissions and 24 free shots on the hour—an odd choice of number, since Jones is turning 23."

"• North Carolina: If any program's fans should be shaking after Tuesday's ruling, it's the Tar Heels'. UNC went before the committee in October, and its verdict is expected shortly. When its Notice of Allegations came out this summer, fans hung their hopes for a lenient sentence on the following facts: 1) It avoided the dreaded Lack of Institutional Control charge, receiving Failure to Monitor instead; and 2) The school was proactive, suspending players itself as soon as allegations of misconduct arose prior to the 2010 season.

Well, Ohio State was also charged with Failure to Monitor. It self-reported every violation in Tuesday's report, preemptively fired Tressel, disassociated Pryor and DiGeronimo and self-imposed several penalties -- and still it got hit with a bowl ban. North Carolina should expect even worse, considering its case is wider in scope and involves two of the NCAA's biggest no-nos -- academic fraud and agent violations. I'd expect a two-year bowl ban and at least one docked scholarship for every player that received impermissible benefits or improper academic help.

Of course, the NCAA doesn't really seem to use other cases as precedent, but hopefully the OSU case shows how they feel about things these days.

My take: They declared him ineligible then asked to reinstate him in the same breath. I guess that really shows just how hardcore their decision to declare him ineligible was.

^^^ from the same article.

Quote :
"While the NCAA loves to remind us that no two cases are the same, the Committee actually made two references in Tuesday's report that suggest otherwise. At one point, in discussing the "insider" status enjoyed by now-disassociated booster Bobby DiGeronimo (who paid several players $200 apiece for appearing at his charity event and hooked up some with unapproved short-term jobs), the report specifically references a 2003 case at Arkansas involving a similar figure. Later, the committee writes that they considered issuing a multi-year ban but refrained "after weighing the aggravating factors and the overall seriousness of the case in light of other recent major infractions cases where a multiple year postseason was imposed."

As we know, UNC is the poster child team so they won't really get anything.

^,^^^^Not to mention that UNC is a poster child within the Carolinas. You move out to Virginia and they see UNC as "a talented school" but hardly a poster child.

^ bingo. that's what's so infuriating. they knew EXACTLY what they were doing and what they were gonna do, but instead made up this song and dance about "oh, he's sorry, he didn't know...", knowing full well that this dumbass was gonna have the party anyway and use the same damned poster for it. I can't imagine a bigger "fuck you" to the NCAA than that.

I follow @unccompliance on twitter and it's funny to me some of the stuff they post. Here is a tweet from today...

Quote :
"Student-Athletes:Is this your last semester at UNC and only need a couple of credits to graduate?Get underload approval, contact Susan Maloy"

Hasn't the semester started? Don't all athletes have advisors and wouldn't they know if they were "under loaded"? I feel like they are trying to become clean in the eye of the public when this type of stuff is business as usual for all colleges.
