I'd guess her insurance company would get into it with the property owner's home insurance.2/21/2010 5:29:53 PM |

Yeah I don't know the girls name so that ends that, but she was black and young. Well dressed, looked like a college student.
My house is on the corner of marcom and gorman, everythings boarded up now.
I'll post the interior pics and the amazing trajectory she was on to even hit my house like that, she's lucky to be alive as well, but she had no injuries 2/21/2010 7:21:35 PM |

so I went to my house yesterday and everything was boxed up already. the insurance company is trying to fuck me, making me pay a $500 deposit, replacing a few things but not everything but I'm losing all the extended warranties I bought on my TV, sorround sound, etc. and the taxes I paid on them. they will only reimburse me for the price of the item... I still have to pay rent, yes, still have to pay rent to not live in my house 2-6 months. I have to live at my parents house in North Raleigh, and drive an extra 40 miles a day to class, and 50 miles to work and I get no reimbursement for that. so all in all, I have to pay money to not get all my stuff back, I have to spend an extra hour to an hour and a half driving every day, and I have to pack/unpack my whole house.
as some of you may know, I breed German Shepherds, and my stud dog, Gunnar, was with me when this happened. The next day I sent him to stay with our other dogs in Calabash, but I got a call this morning from my grandmother saying he was going into surgery because apparantly glass shards from the accident unbeknown to me cut his inner leg open
here's a pic of the shepherd

That seems pretty ridiculous. Is it your insurance company or her insurance company? Are you going to file charges against her?
Also seems weird that you have to pay rent, at the least that will be something you should go after the girl for. 2/23/2010 1:49:09 PM |

damn that blows, all of it
i think the fact that you cant live in the house for several months should be sufficient to get you out of your rental contract... 2/23/2010 1:49:26 PM |
Arab13 Art Vandelay 45180 Posts user info edit post |
get a good lawyer, you will definitely get out of the rental contract as the unit is un-inhabitable now, and you will get more money for replacement items (probably not enough to cover the tax spent on them or most of the 'extended' warranties though)

No you don't. NC rental law says the house has to be habitable. The landlord should take loss of income up with the driver. I wouldn't send another check for rent and if they don't refund you for the days for which you've already paid and the house was inhabitable you should sue. You might have to play hardball with them on this, but don't take anything.
The insurance company should cover the warranties minus a pro-rated amount for the time you have owned the device. You probably just need to argue more with them or go ahead and consult with a lawyer on both issues.
Good luck with your dog and your claims. Just don't let the stress get to you. Keep track of every date/time/person you speak with and take notes of the conversations. Follow up with the driver's insurance company for anything that your insurance doesn't cover.

I'm hiring an attorney on Monday to go after this girl. The police report still hasn't been released so I don't even know her name yet, but I will soon.
It's my rental insurance company that's fucking me. The girl that hit my house was driving her friends car, I'm not sure if she's even insured but from what I'm told I can go after the car owners insurance company, so that's what I'll do.
Sue for: Gas money Vet bills Mileage on my car Rent money My deductible And if I can some sort of inconvenience/pain and suffering?
^^ I hope that I won't have to pay the rent but as far as what we know so far only a month is covered and I can live in a hotel during that time but repairs are set to take 2-6 months. I'll know more tomorrow on that.
the shitty part of all this is that I'm already stretched from full time grad school plus half time work and all of this is so time consuming.

I guess if all else fails you could take the girl to small claims court or something to pay you back for the time/gas/stress/vet fees/etc. 2/23/2010 1:56:53 PM |

+1 to what skack said, plus two more things: read your rental insurance policy - see what it actually says about replacements, values, deductibles, and such read the relevant parts of NC ch 42 - that's what covers rental stuff
I, too, want to know who the fuck says you have to pay rent.
