Alright. First of all, machine guns, destructive devices, short barreled shotguns, and short barreled rifles, as well as the 'any other weapon' category are all part of the National Firearms act. It was put into place just after prohibition ended. It is 'Title II' of firearms law. Thus all guns udner it are Title II items. Title I items are things you can buy at any sporting goods store or gun show with normal paperwork and no additional taxation. see http://en.wikipedia.org/wiki/National_Firearms_Act for info on Title II and see http://en.wikipedia.org/wiki/Gun_Control_Act_of_1968 for info on Title I. Title I was then modified by FOPA, passsed in 1986. See http://en.wikipedia.org/wiki/Firearm_Owners_Protection_Act This modification cut off all new additions to the title 2 registry list for machine guns. thus the pre/post 86 reference on many advertisements for full auto stuff. See the bottom of this post for what 'class' means Items controlled by this act MUST be registered with the federal government, and must have a tax paid to transfer them to a new owner. There is no 'permit' issued to the new owner, just a tax stamp issued, showing that the transfer was allowed to take place, and the tax paid. The federal government 'denies' transfers by refusing to allow you to pay the tax.

(Many firearms with bores over 0.50", such as 12-gauge shotguns, are exempted from the law because they have been determined to have a legitimate sporting use.) Any Other Weapons (AOWs) - this is a broad "catch-all" category used to regulate any number of firearms which the ATF deems deserving of registration and taxation. Examples include, among others: Smooth-bore pistols Pen guns and cane guns Short-barreled firearms with both rifled and smooth bores, etc. Disguised firearms Firearms that can be fired from within a wallet holster or a briefcase A short-barreled shotgun which came from the factory with a pistol grip is categorized as an AOW rather than a SBS, because the Gun Control Act describes a shotgun as “…designed or redesigned to be fired from the shoulder…” Handguns with a forward vertical grip. It is therefore illegal to place an aftermarket foregrip on any pistol without first registering it as an AOW and paying the $200 "making tax" imposed by the Act." |

To get a Class 3 SOT status, you need a dealer or manufacturer FFL which includes Type 1, 2, 7, 8, 9, 10 or 11 - and pay a yearly $500 tax due every July 1st.
To get a Class 2 SOT status, you need a manufacturer FFL, which includes Type 7, 10 - and pay a yearly $1000 or $500 (reduced rate for small manufacturers) tax due every July 1st.

What do you want one for? the 92 series is what you're looking for (M9 is the military designation for it)...but after shooting probably thousands of rounds through them, I know I'd rather have a SIG. There's nothing really wrong with the Beretta--it's dependable and pretty accurate, but I don't really see what's particularly desirable about it, either.
