PJ is a miniature UNC

Commits tons of minor infractions that aren't large enough to pursue individually and no one has the gumption to compile the offenses.

PJ: Drugs/Gun/License/Rental -> Minor Suspension

UNC: Failure to monitor/fake classes/ agents on staff/ rental cars/ mouth guards/ jewelry/ cell phones/ Tutors/ parking tickets -> Forfeit wins, bowl ban, and 'probation'

I will say the Durham DA department has had some issues in the past with corruption, they just booted the DA last year and currently have an interim. Could be a resource thing too since they are having some issues.

through a quick search, i found a power point presentation on TASC that said the average participant stays in the program for 6 months

If you are a first time offender there is a program called 90-96. They are specifically for drug related offenses and is for people with no prior convictions as a type of first time offenders program. If they complete the program, and don't get in any other trouble during the period (a year) then the charges will be dropped. So yes, it would happen to any of us and I've seen it happen many times. (I am going off of Wake County policy for the 90-96 program. That program may be a statewide program, or if its just Wake County, I would imagine Durham County has a similar program.)

Actually I just googled it and 90-96 is a statewide thing. It is actually in the general statutes:

and i still can't believe they just forgot about the gun and ammunition (would that do that for any of us?)

I haven't actually seen where everyone is getting an ounce and a half. I don't actually remember from the original incident and I can only go by what I'm reading (I know its WRAL and I can't believe much there):

WRAL is wrong. Police report had one bag with 41.1 grams and another with 2.1 grams. Both under 1.5 oz but total is over 1.5 oz.

Also 41.1 is barely under 1.5 itself, which makes me think it was probably more and he was cut another break.

Not to mention it doesn't include all the pot that was dumped outside the car next to the loaded gun

If we're all being honest no one really gives a shit about the weed. If it had just been weed we would laugh and joke but that's about it. But...

1. All the incidentals of the encounter: rental, gun, license, seat swap, etc. Shouldn't this have an impact on this not just being another simple possession slap on the wrist?
2. Are the other guys in the car getting the same deal or was there some reason they are getting more than PJ?

^Maybe the other guys in the car have prior convictions. Maybe the other guys in the care pissed the district attorney off. There are a ton of different factors that can cause someone not to qualify for the program.

And no, none of that other stuff would matter in qualifying for the program

this says 43.2 grams. 42 grams is 1.5 ounces, which is a felony.

So regardless if it was a felony or misdemeanor, program is still available. It happens all the time. I've seen it. Hell when I was interning in Wake County I gave it to people.

As was said before, the weed is not the issue. Car rentals, mouth guards, and new emails are the damning stuff at UNC-Cheat

i'm no conspiracy theorist, but i think the real reason is "maybe the other guys aren't stars on the UNC basketball team".

oh, i agree, i just think he got preferential treatment. an ounce and a half with baggies, a gun and ammunition, no license, tries to switch seats, in a known rough area of Durham.... and he gets nothing. that wouldn't be the case for most of us.

You can call it a conspiracy all you want. This was in Durham. Not Chapel Hill. Durham, the place where Duke is located. The county that has a District Attorney who went to North Carolina Central University for undergrad and North Carolina Central University for law school, was a judge in Durham for 20 years and was appointed district attorney because the previous district attorney was doing illegal stuff. So no I'm going to say he is doing what he sees as right.

that definitely was the case for my friends in high school (for similar amounts) and me (for less amount). that program actually sounds a lot more involved than what any of us ever had to do.

(the gun is different from my friends, but they can't charge anyone for that because its impossible to prosecute)

Best case scenario was PJ missing significant time.
That is no longer the case.

UNC already covered their butts on the mouthguards.
Rental will go down as yet another shady character near the program but not enough to get the NCAA off it's ass.

^^Who was sitting in the drivers seat when it was thrown out? Can you say beyond a reasonable doubt that PJ was in the driver seat when the gun was thrown out. Or is it reasonably possible Miykael Faulcon was in the drivers seat when the gun was thrown out. If you cannot prove who was sitting there when the gun was thrown out, then there is a reasonable doubt who threw the gun, and who was possessing the gun.

^I thought usually in cases like that, when they can't pin it on one of the occupants, they either charge the driver or all of the occupants. i didn't know there were cases where they just decided not to charge any of the occupants.

I'm fairly certain he's referring to me as the "legal scholar."

To have probable cause, there has to be a link between two things: there was a crime committed, and the person being charged was the one who committed the crime. There may very well be probable cause to charge PJ in this case with the gun. Due to the proximity of the vehicle stopping and where the gun was found, there is constructive possession. But charging someone and getting a conviction are completely different. I'm sure the DA's office is looking at whether or not they want the publicity. In this case I think the "preferential treatment" being given is that he isn't charged. I don't think anyone would be convicted, but they may plea guilty prior to trial. DA probably knows he won't plea and knows he will lose at trial. No sense in dragging it out for a losing effort.

The greatest thing that can come from any of UNCs bullshit at this point is for this to keep happening and for the NCAA to piss off every fan base in the nation by not doing a damn thing with it.

That way every time UNC wins anything there will be a collective "doesn't count" uttered across the nation.
