Driver charged in fatal I-40 crash in Durham
Feb 17, 2013 12:14 p.m.


Durham, N.C.—Durham police have charged a High Point man with driving while impaired in a two-car crash early Sunday that killed one person.

Police said Raul Herrera, 31, swerved into the back of a Nissan Maxima around 3:40 a.m. on Interstate 40 East near N.C. Highway 54. The impact sent both cars off the road, where they overturned.

The driver of the Maxima, whose name was not released, was pronounced dead at the scene.

Herrera was taken to a local hospital to be treated for non-life-threatening injuries. He faces one count of driving while impaired, and the crash remains under investigation.

There were no passengers in either vehicle.

Interstate 40 East was closed for more than four hours while authorities investigated the wreck, which does not appear to be weather-related.

Would you be willing to accept a transition to all new cars having this type of seat belt if it was scientifically proven to reduce traffic deaths?

I have never really had a problem with seat-belts, they seem preferable to being thrown at high velocity through a glass window and out in to a tree or on to a road surface, etc.

^ but the point is that seat belts are less safe than they could be. Not only could they be made more safe, but they could be made more safe very cheaply.

Yes, you have established that wearing a seat belt (any seat belt for that matter) is safer than wearing none.

Instinctively, yes. That said, there has been some research showing that seat belt laws actually cause an increase in risky behavior, and it would seem like such an effect could be seen with new seat belts like these. Overall, though, research seems to show a significant in decrease in serious injuries and fatalities so that probably outweighs the behavioral change.

I'm more concerned personally with changing the way we design roads. We can put a 35 MPH speed limit on a road, but if it has been designed with 15 foot wide lanes and long straightaways that make driving 80 MPH feel comfortable, what does anyone expect to happen? With sober drivers this makes behavior more dangerous. I wonder if it is the same way with drunk drivers. I would be interesting in seeing some sort of study on that looking at characteristics of roads that have drunk driving fatalities and serious injuries (I know that they are often in rural areas).

Risk compensation. Every person has a certain level of risk that they are willing to accept in any activity. Things like seat belts, air bags, etc may make a driver more willing to accept a little more risk; maybe they drive a little faster, follow a little closer, or take a turn a little tighter.

That is obviously not to say that we shouldn't be embracing safety improvements, but it is an interesting effect.

The same thing has been seen in studies involving bicyclists. One study found that drivers give cyclists without helmets on average 8.5 cm more space when passing than those with helmets. Taking it a step further, they gave on average 14 cm more when the cyclist was wearing a long blonde wig! The driver perceives less risk when passing what they perceive to be the least vulnerable seeming user, a man wearing a helmet, and the most risk when passing the perceived most vulnerable, a woman without a helmet.

That's makes sense. I really think that we're not advanced enough of a society to have intelligent risk management conversations.

As a matter of risk-oriented discussion, I ask the above question about seat belts. But then I propose that instead leaving the cost of the car unchanged, we could install the safer seat belts while lessening the engineering in other safety systems, thereby lowering the total cost while keeping the safety rating the exact same. I then ask the person if they'd rather accept the lower cost, or forgo the lower cost and just have a safer car.

My prediction was that most people would accept the lower cost, but so far people have opted for the increased safety instead.

The 55 mph federal speed limit was the best thing the government ever did. It will be back as soon as the next gas crisis hits in the next year or two.

The mother-daughter team saved up and sacrificed to open the business, and they recently received an $11,000 grant from the city to help spur growth.

“We were excited about moving to the next level with our store,” Jackson said. “It will come – it’s just not going to be as soon as we thought.”

The salon is adjacent to other businesses, but it appeared the neighboring stores sustained little or no damage."

After he and his father made her get out of the truck, the man told police she began yelling and walked to her mother's house. That's where police found her when they arrived. They say she was also "irate and very intoxicated." Officer Scott Byrd administered a portable breathalyzer test to Craft. "Because she could barely stand," he and Officer Cody Coley had to hold her shoulders "so that she would not fall over," according to Byrd's report. Byrd reported the PBT gave a reading of .217 blood alcohol content, which is nearly three times the legal limit. During the investigation, Officer Coley reported Craft "started to yell and scream." She continued to scream after she was placed into custody and began to kick the door of his police car, he reported. According to the report, Craft continued to be very disorderly and uncooperative once she arrived at Craighead County Detention Center, according to the report. Craft was left at the jail in lieu of $2,067 surety bond."

No one answered the door at Acevedo's last known address, in a public housing complex in Brooklyn. Neighbors said his mother lived in the same building, but she did not answer her door.
"We in the community are demanding that the prosecutor charge the driver of BMW that caused the death of this couple and infant be charged with triple homicide; this coward left the scene of the accident not even bothering to check on the people of the other car," Abraham said according to MyFoxNY.com.
Brooklyn is home to the largest community of ultra-Orthodox Jews outside Israel, more than 250,000. The couple wed last year in a marriage arranged through a matchmaker and were living in the Williamsburg neighborhood.
They were members of the Satmar Hasidic sect, whose men dress in dark coats and hats, wear long beards like their Eastern European ancestors and have limited dealings with the outside world. Raizy Glauber grew up in a prominent rabbinical family. Her husband was studying at a rabbinical college; his family founded a line of clothing for Orthodox Jews.
Sabel, dressed in the traditional long black coat of the Satmar, said it was a terrible tragedy.
"But it's what God wants," he said. "Maybe the baby's death, and his parents', is not for nothing; God doesn't have to give us answers."
Shortly after midnight Sunday, Raizy Glauber, who was seven months pregnant, wasn't feeling well, so the couple decided to go to the hospital, said Sara Glauber, Nachman Glauber's cousin. They called a livery cab, a hired car that is arranged via telephone, not hailed off the street like a yellow cab.
The livery cab had a stop sign, but it's not clear if the driver stopped. Police said the crash with the BMW reduced the cab to a crumpled heap, and Raizy Glauber was thrown from the wreck. The engine ended up in the back seat, Abraham said.
The baby weighed only about 4 pounds when he was delivered, neighbors and friends said. He died of extreme prematurity, the city medical examiner's office said.
The driver of the livery cab, Pedro Nunez Delacruz, was knocked unconscious but was not seriously hurt. His vehicle should not have been sent to pick up the passengers because an application to use the Toyota as a livery cab had not yet been approved, the city Taxi and Limousine Commission said.
How Acevedo came to possess the BMW is also under investigation. The registered owner, Takia Walker, was arrested on insurance fraud charges Sunday in a scam involving the car, police said. She was not involved in the crash. A telephone number registered to Walker rang unanswered.
A person familiar with the investigation said Walker bought the car legally, or allowed her identification to be used in the purchase, then gave the vehicle to a middleman who either lent or rented it out to the driver. The person was not authorized to speak publicly and spoke to The Associated Press on condition of anonymity.
No one answered the door at Acevedo's last known address, in a public housing complex in Brooklyn. Neighbors said his mother lived in the same building, but she did not answer her door.

Wade is a 4 lane road with a small concrete median at that point. Happened just outside the house yesterday afternoon. They had the road closed for a little over 3 hours too.

Apparently the guy has had previous DUIs that were dropped too. Hope he gets some good time finally.

I'm trying to place that picture, is that right before the railroad tracks? So he turned left off of N West St. and hit them between there and Filmore?

I've seen someone turn left off N West onto Wade before (although they were sober, immediately recognized their mistake, and quickly backed up)

Odd thing about Drunk Driving. Many people that do it know its stupid, hence all the cops, judges, politicians, and many otherwise responsible people that get caught for DWI.

Wrong way drunk drivers are usually blacked out drunk and do not even recall making the decision to drive.
