I'm not a lawayer, so if you are please chime in. Never been in this position but it was explained to me like this:

If you charge someone with an infraction - which I believe driving wrong way on dual lane is - and that driving causes a death and you are charged with that death, you can plead guilty to the citation (by pre-pay) and the other charge becomes double jeopardy because its not a lesser included offense.

Might be wayyyy off base and they may have changed the law in 2010 or 11.

RALEIGH -- A city firefighter damaged six parked cars on a street leading into her apartment complex early Wednesday morning, leading Raleigh police to arrest her for driving while intoxicated.

Shannon Lee Haeck’s blood alcohol level tested at 0.13, according to police; the legal limit in North Carolina is 0.08.

Police said Haeck, 33, was traveling on Mellow Field Drive, near Six Forks Road and Atlantic Avenue, after 3 a.m. at 40 mph. The road in front of the Manor Six Forks complex has a limit of 25 mph.

Her 2006 Jeep Commander drifted left as it was traveling northeast. She sideswiped four different vehicles that were parallel-parked on the left side of the road about 1,000 feet from her Moratuck Drive apartment. The car came to rest with major front-end damage after striking the rear of a 2000 Ford Explorer, according to the police report. The Explorer, lurching forward, also damaged an SUV in front of it.

The Raleigh Fire Department did not immediately return calls regarding Haeck’s employment status.

I can't imagine that being true...but I haven't had any experience with double jeopardy nor do I remember shit from law school about it. But I always remembered double jeopardy as being the same or similar crime. So pleading guilty to a traffic offense shouldn't effect a vehicular manslaughter, IMO.

"The state highway patrol reports that a Cary man died early Wednesday morning after driving his car into Jordan Lake.

Trooper Greg Ingram identified the victim as Anthony Thomas Fico, 21, of 117 Milley Brook Court.

Ingram said Fico was driving his 2012 Ford Mustang west along Martha's Chapel Road. When Fico approached the T-shaped intersection with Farrington Point Road, Ingram said Fico failed to turn right or left, instead driving straight into the guardrail and going airborne into the lake.

Authorities got the call about the incident at about 12:50 a.m. Wednesday. Authorities have since recovered Fico's body and car from the lake.

"Raleigh, N.C. — Two people were killed and another injured early Sunday in a wrong-way crash on Interstate 40 and Jones Sausage Road in Raleigh, police said.

Carolina Elizabeth Gonzalez Linares, of Morrisville, was driving a Toyota sedan south in a northbound lane around 2:30 a.m. when she collided head-on with a Ford truck, according to a wreck report.

Both vehicles were traveling at about 65 mph, the report states.

Linares, 28, and a passenger in the Ford truck, 17-year-old Job Misrael Hernandez, of Raleigh, were killed.

The other driver, 21-year-old Natanael Bartolome Hernandez, also of Raleigh, was taken to WakeMed, where he was listed in critical condition Sunday afternoon.

The northbound lanes of I-40 were closed in the area for more than 4 hours while authorities investigated at the scene.

The cause of the wreck is under still investigation and alcohol test results are pending, police said.

No other information was released."

Quote :
"Drunk-driver given 18 months for crash involving Paralympian cyclist Edward Adams left medal-winning cyclist Simon Richardson with multiple injuries including fractured spine in hit-and-run crash

Simon Richardson was training when Edward Adams knocked him off his bike.

A farmer who shattered a Paralympian's 2012 dream in a drink-drive crash has been jailed for 18 months. Medal-winning cyclist Simon Richardson had been training for the Games near his home in Bridgend, south Wales, when 61-year-old Edward Adams knocked him over in his van before driving off. Richardson's catalogue of injuries included a fractured spine, broken pelvis, collapsed lung and perforated bowel.

After the crash, alcoholic Adams then rushed back home to hide his vehicle before pouring himself a glass of whisky – in a bid to try to disguise the fact he had been drinking before the collision, Cardiff crown court was told. Judge Daniel Williams said Adams had shown limited empathy for his victim, and none of the courage and dignity displayed by Richardson. He said: "You first got into the car at 8.45am that morning and when you were breathalysed just after midday you were more than twice the legal drink-drive limit.

"Mr Richardson was clearly visible, cycling close to the kerb and wearing bright clothing.
"Your claims that you were affected by sneezing and sunlight were wholly untrue.
"Your reaction to the accident and its aftermath could not be in greater contrast with the man that you had left injured. "You took the opportunity to leave the scene knowing you had caused the accident." Richardson, 44, who won two gold medals and a silver in 2008, was training for the Paralympics on a stretch of the A48 known locally as Crack Hill in August last year.
The court heard he was thrown 26m (85ft) into the air after Adams's van hit him from behind.
He stopped briefly, but drove off after he noticed another motorist had stopped to offer Richardson assistance. Adams then attempted to hide his Peugeot van at his farm. It was eventually located by a police helicopter, and was found with damage to a wing and the windscreen. When interviewed by police, Adams said he had been drinking the night before and had drunk his first whisky at 6am when he woke up.

He admitted drink-driving and failing to stop, but denied a charge of dangerous driving. Williams described Adams's version of events during his trial as "instinctive lies" and said the sentence he imposed reflected the serious harm and injury Richardson had been caused. Adams was given a 15-month prison sentence for dangerous driving, and an extra three months for failing to stop. A three-month sentence for driving with excess alcohol will run concurrently. Adams will also be disqualified from driving for five years. Following the court's verdict, Richardson said he faced an uncertain future.

The father-of-two said: "I still have another operation to go through, which if it is unsuccessful could leave me permanently paralysed. "It's also been difficult to miss out on taking part in the London Paralympics. "But I am a strong person, and plan to keep on fighting. "As for the court's verdict, I am happy in a way with the sentence. "I would have been happy whatever sentence he got, even if he walked free. "At the end of the day, it was just an accident and he did not deliberately set out to knock me down.

"But it is important that a precedent has been set – that not only should a person be charged with excess alcohol but it also qualifies as dangerous driving. "I hope this incident shows the need for drivers to be more aware of cyclists on the road.""

^ good point.

Except when he went flying through the subdivision across yards and in to a tree, there is no telling how many more people would have been taken out had they been in the way. This guy is above and beyond driving drunk, he was driving like a stupid asshole on top of that, and he was on probation.

I am all for giving people a pass once in a while for momentary lapses of judgement, but this guy obviously does not give a shit about anything.

Imagine you were out walking your dog and then lights out. . . . .

One reason that they don't decide to put BAC's in cars is because people will sit there and wait until they can blow a .08, then don't drive as smart because they assume they're at a "safe level" to drink... Just because you blow a .08 doesn't mean you are making a good choice. They could be on something else or extremely tired. They would try and leverage it as defense in court, too.

And yeah it would be expensive to put them in every car.

Keep in mind that the fact that he was on probation at the time of his crime will now result in a revocable violation of that original probation case. It is likely that he could serve his active sentence on the original case in addition to the 6 month split sentence just handed down. Additionally, 5 years is a long time to be on probation, particularly for someone his age. The likelihood of him winding up in violation court during that time is fairly high

yea but this kid spending 6 yrs in prison won't do anything but make him part of the system and likely a repeat offender. So maybe their idea in sentencing was to rehabilitate this kid.

I hate this kid and his stupid decisions, but I also believe in drug courts. That being said he killed a person and that is a criminal offense, and 6 months is kind of bullshit.

I think they are hoping this kid will get an education during his probation and make something of himself. lulz

Especially when he was so fucking stupid the first time he was on probation that he fucked up and killed somebody while driving shitfaced. I think he will fuck up his probation withing the first 90 days.... If I was the girls family I would hire a private investigator to follow him around and send pictures of anything he does wrong to the DA and WRAL.

^^That's exactly what the article said. It's retribution and rehabilitation. That's why they aren't pushing for more than 6 months. The Judge wants this guy to make something out of his life, so the girl didn't die in vain.

I guess he is sort of PWNT. 6 months + 5 Years of missing right after Christmas & new years + Probation + 300 hours of speaking about the dangers of drunk driving. He is not allowed to drink at all while on probation either.

By the way, I don't know what kind of program they have in North Carolina, but I had a buddy in South Carolina who couldn't drink or do drugs for a whole calendar year....and it was literally impossible for him to do either. He got blood tested once a week with two "random" tests a month in addition.

He unfortunately turned back into a mess after those 365 days (man in his older 30s...he's way past changing)...but I was pretty impressed with how they kept him from doing anything.

For a while there pretty much everyone on probation in NC was getting violated for any minor slip up, like it was virtually impossible not to get violated...that was right after Eve Carson, so I am not sure how much it has relaxed since then.
