I'm not a lawayer, so if you are please chime in. Never been in this position but it was explained to me like this:
If you charge someone with an infraction - which I believe driving wrong way on dual lane is - and that driving causes a death and you are charged with that death, you can plead guilty to the citation (by pre-pay) and the other charge becomes double jeopardy because its not a lesser included offense.

I can't imagine that being true...but I haven't had any experience with double jeopardy nor do I remember shit from law school about it. But I always remembered double jeopardy as being the same or similar crime. So pleading guilty to a traffic offense shouldn't effect a vehicular manslaughter, IMO.6/21/2012 10:26:51 AM |

Judge Daniel Williams said Adams had shown limited empathy for his victim, and none of the courage and dignity displayed by Richardson. "Mr Richardson was clearly visible, cycling close to the kerb and wearing bright clothing. "Your claims that you were affected by sneezing and sunlight were wholly untrue. "You took the opportunity to leave the scene knowing you had caused the accident." Richardson, 44, who won two gold medals and a silver in 2008, was training for the Paralympics on a stretch of the A48 known locally as Crack Hill in August last year. The court heard he was thrown 26m (85ft) into the air after Adams's van hit him from behind. He stopped briefly, but drove off after he noticed another motorist had stopped to offer Richardson assistance. Adams then attempted to hide his Peugeot van at his farm. It was eventually located by a police helicopter, and was found with damage to a wing and the windscreen. When interviewed by police, Adams said he had been drinking the night before and had drunk his first whisky at 6am when he woke up.
He admitted drink-driving and failing to stop, but denied a charge of dangerous driving. Williams described Adams's version of events during his trial as "instinctive lies" and said the sentence he imposed reflected the serious harm and injury Richardson had been caused. Adams was given a 15-month prison sentence for dangerous driving, and an extra three months for failing to stop. A three-month sentence for driving with excess alcohol will run concurrently. Adams will also be disqualified from driving for five years. Following the court's verdict, Richardson said he faced an uncertain future.
The father-of-two said: "I still have another operation to go through, which if it is unsuccessful could leave me permanently paralysed. "It's also been difficult to miss out on taking part in the London Paralympics. "But I am a strong person, and plan to keep on fighting. "As for the court's verdict, I am happy in a way with the sentence. "I would have been happy whatever sentence he got, even if he walked free. "At the end of the day, it was just an accident and he did not deliberately set out to knock me down.

Except when he went flying through the subdivision across yards and in to a tree, there is no telling how many more people would have been taken out had they been in the way. This guy is above and beyond driving drunk, he was driving like a stupid asshole on top of that, and he was on probation.
I am all for giving people a pass once in a while for momentary lapses of judgement, but this guy obviously does not give a shit about anything.

One reason that they don't decide to put BAC's in cars is because people will sit there and wait until they can blow a .08, then don't drive as smart because they assume they're at a "safe level" to drink... Just because you blow a .08 doesn't mean you are making a good choice. They could be on something else or extremely tired. They would try and leverage it as defense in court, too.

Keep in mind that the fact that he was on probation at the time of his crime will now result in a revocable violation of that original probation case. It is likely that he could serve his active sentence on the original case in addition to the 6 month split sentence just handed down. Additionally, 5 years is a long time to be on probation, particularly for someone his age. The likelihood of him winding up in violation court during that time is fairly high 9/29/2012 2:38:05 AM |

yea but this kid spending 6 yrs in prison won't do anything but make him part of the system and likely a repeat offender. So maybe their idea in sentencing was to rehabilitate this kid.
I hate this kid and his stupid decisions, but I also believe in drug courts. That being said he killed a person and that is a criminal offense, and 6 months is kind of bullshit.

I think he will fuck up his probation withing the first 90 days.... By the way, I don't know what kind of program they have in North Carolina, but I had a buddy in South Carolina who couldn't drink or do drugs for a whole calendar year....and it was literally impossible for him to do either. He got blood tested once a week with two "random" tests a month in addition.
He unfortunately turned back into a mess after those 365 days (man in his older 30s...he's way past changing)...but I was pretty impressed with how they kept him from doing anything. 9/29/2012 1:35:04 PM |
